There is hereby established in the Borough of
Ramsey, pursuant to N.J.S.A. 2A:8-1, as amended and supplemented,
a municipal court which shall be entitled the "Municipal Court of
the Borough of Ramsey."

The Municipal Court of the Borough of Ramsey
shall have a seal which shall bear the impress of the name of the
Court.

The Judge of the Municipal Court shall be appointed
by the Mayor with the advice and consent of the Borough Council. The
Judge of the Municipal Court shall serve for a term of three years
from the date of his appointment and until his successor is appointed
and qualified. Any appointment to fill a vacancy caused other than
by expiration of term shall be made for the unexpired term only.

The Municipal Court shall have, possess and
exercise all the functions, powers, duties and jurisdiction, both
territorial and subject matter, in such matters as conferred upon
the Court pursuant to N.J.S.A. 2A:8-1, et seq., as amended and supplemented,
and by any other acts of the State Legislature.

The Municipal Court Judge shall receive compensation
as established by the Borough Council.

The Mayor and Council shall, provide for a Municipal
Court Administrator, Deputy Court Administrator, and, any other necessary
clerical and other assistants as may be required for the Municipal
Court. Compensation for the Municipal Court Administrator, Deputy
Court Administrator and other Court personnel shall be fixed annually
by the Borough Council.

There shall be a Borough Prosecutor and two
Assistant Borough Prosecutors, all of whom shall be appointed by the
Mayor with the advice and consent of the Borough Council for a one-year
term commencing on January 1 or such later date on which the Borough
Prosecutor and Assistant Borough Prosecutors may be appointed, until
December 31st of the year for which he is appointed and until his
successor shall have been appointed and qualified. Any vacancy in
the position occurring other than by expiration of term shall be filled
in like manner, but for the unexpired term only.

The Borough Prosecutor and Assistant Borough
Prosecutor shall be attorneys-at-law of the State of New Jersey and
shall perform the duties of the Borough Prosecutor in accordance with
the laws of the State of New Jersey and ordinances of the Borough
and shall be the advisor to Municipal Court personnel and the Police
Department in matters relating to their duties concerning the prosecution
and preparation of all charges and complaints against every person
charged with a violation of any of the laws of the State of New Jersey
and the ordinances of the Borough, and shall appear in the appropriate
court in the prosecution of every person charged with a violation
of any state, county or municipal law or ordinance.

The Borough Prosecutor and Assistant Borough
Prosecutor shall receive compensation as fixed annually by the Borough
Council.

a. There shall be a Public Defender and two Assistant
Public Defenders who shall be appointed by the Mayor with the advice
and consent of the Council for a term of one-year commencing January
1 and until his successor shall be appointed and qualify.
b. The Public Defender shall appear before the Municipal
Court to defend the cases of indigent persons which are referred to
him by the Judge of the Municipal Court.
c. The Public Defender shall receive compensation as
fixed annually by the Borough Council.
