The Borough of Ramsey Environmental Commission is hereby established pursuant to N.J.S.A. 40:56A-1, et seq.

The Commission shall consist of seven members appointed by the Mayor, one of whom shall also be a member of the Planning Board and all of whom shall be residents of the Borough. The members shall serve without compensation except as hereinafter provided. The Mayor shall designate one of the members to serve as Chairperson and presiding officer of the Commission. The members shall be appointed for terms of three years and until the appointment and qualification of their successors.
The Mayor may appoint two alternate members. The term of the alternate members shall be for two years, except that the terms of the alternate members first appointed shall be two years for alternate number one and one year for alternate number two so that the term of not one more than one alternate member shall expire in any one year. Alternate members shall be designated at the time of appointment as "Alternate No. 1" and "Alternate No. 2". An alternate member may participate in discussions of the proceedings but may not vote except in the absence or disqualification of a regular member. A vote shall not be delayed in order that a regular member may vote instead of an alternate member. In the event that a choice must be made as to which alternate member is to vote, Alternate No. 1 shall vote first.
The Mayor or Council may remove any member of the Commission for cause, on written charges served upon the member and after a hearing thereon at which the member shall be entitled to be heard in person or by counsel. A vacancy on the Commission occurring otherwise than by expiration of a term shall be filled for the unexpired term in the same manner as an original appointment.

The Commission shall have power to conduct research into the use and possible use of the open land areas of the municipality and may coordinate the activities of unofficial bodies organized for similar purposes, and may advertise, prepare, print and distribute books, maps, charts, plans and pamphlets which in its judgment it deems necessary for its purposes. It shall keep an index of all open areas, publicly or privately owned, including open marshlands, swamps and other wetlands, in order to obtain information on the proper use of such areas, and may recommend to the Planning Board, plans and programs for inclusion in the Master Plan and the development and use of such areas.

The Commission may, subject to the approval of the Borough Council, acquire property, both real and personal, in the name of the Borough by gift, purchase, grant, bequest, devise or lease for any of its purposes and shall administer the same for such purposes subject to the terms of the conveyance or gift. Such an acquisition may be to acquire the fee or any lesser interest, development right, easement (including conservation easement), covenant or other contractual right (including a conveyance on conditions or with limitations or reversions), as may be necessary to acquire, maintain, improve, protect, limit the future use or otherwise conserve and properly utilize open spaces and other land and water areas in the Borough.

The Commission shall keep records of its meetings and activities and make an annual report to the Borough Council.

The Commission may appoint such Clerks and other employees as it may require, providing the same shall be within the limits of funds appropriated to it by the Borough Council.

The Commission shall have power to study and make recommendations concerning open space preservation, water resources, management, air pollution control, solid waste management, noise control, soil and landscape protection, environmental appearance, marine resources and protection of flora and fauna.

The provisions of this subsection shall apply to all zone districts in the Borough.
b. 
All plans and applications to the Borough Planning Board, the Zoning Board of Adjustment or the Building Department for site plan approval, major subdivision approval or for approval of any new use or change in use shall be referred to the Environmental Commission for review and neither the Planning Board, the Zoning Board of Adjustment nor the Building Department shall take final action upon any application until the report and recommendation of the Environmental Commission is received and considered. In conjunction with such review, an application and the information required therein shall be submitted to the Environmental Commission on the application form entitled, "The Borough of Ramsey, Bergen County, New Jersey, Application for Environmental Commission Review", which form is incorporated herein by reference and made a part hereof and a copy of which is on file in the office of the Borough Clerk and with the Secretary of the Environmental Commission.

The regulation, planting, care and control of shade trees and ornamental trees and shrubbery upon or in the highways, parks and parkways of the Borough shall be under the authority of a commission known as the "Shade Tree Commission of the Borough of Ramsey."

The Commission shall consist of seven members and two alternate members who shall be appointed by the Mayor.

a. 
The terms of office of the Commissioners first appointed shall begin upon the day of their appointment and continue for the respective periods of one, two, three, four and five years from the first day of January next succeeding such appointment (except that two shall be appointed for five years and two shall be appointed for four years) and the terms of said appointments are to be designated in their respective appointments. All appointments of Commissioners thereafter made, except to fill vacancies, shall be made to take effect upon the first day of January each year, for a full term of five years. Any vacancy occurring in the membership of the Commission by reason of the death, resignation or removal of any Commissioner, shall be filled by the Mayor for the unexpired term.
b. 
Alternate members shall be designated at the time of appointment as "Alternate No. 1" and "Alternate No. 2" and shall serve during the absence or disqualification of any regular member or members. The term of each alternate member shall be five years commencing on January 1 of the year of appointment; provided, however, that in the event two alternate members are appointed, the initial term of Alternate No. 2 shall be four years and the initial term of Alternate No. 1 shall be five years. The terms of the first alternate members appointed pursuant to this section shall commence on the day of their appointment and shall expire on the fourth or fifth December 31 next ensuing after the date of their appointments, as the case may be. An alternate member may participate in discussions of the proceedings but may not vote except in the absence or disqualification of a regular member. A vote shall not be delayed in order that a regular member may vote instead of an alternate member.

The Shade Tree Commission shall organize within 30 days after appointment of its total membership and shall elect one of its members as President and appoint a secretary, who need not be a member of the Commission.

There is hereby created and established a Municipal Swimming Pool Commission of the Borough, the members of which shall be appointed by the Mayor with the advice and consent of the Borough Council.

The Commission shall consist of five residents of the Borough.

The term of office of all members shall be three years. All terms shall terminate on December 31 of the appropriate calendar year. Vacancies shall be filled only for the unexpired term. Members of the Commission shall serve until their successors are appointed and shall qualify. The members of the Commission shall receive no compensation for their services but shall be reimbursed for actual expenses.

The Commission is hereby authorized to manage, operate, maintain and improve the present swimming pool facilities in Conklin Park, and, if the need arises, to conceive, plan, establish and construct additional swimming pool facilities on behalf of and for the Mayor and Borough Council. All of the aforesaid authority shall be subject to approval by the Mayor and Council.

All moneys collected by the employees of the Borough in the operation of the municipal swimming pool and any of its facilities, or turned over to the Commission, shall be turned over daily to the Treasurer of the Borough and all bills and expenditures in connection therewith shall be approved by the Mayor and Council.

The Mayor, with the advice and consent of the Council, may appoint two alternate members of the Municipal Swimming Pool Commission of the Borough. Alternate members shall be designated at the time of appointment by the Mayor as "Alternate No. 1" and "Alternate No. 2." The term of the alternate members shall be for two years, except that the terms of the alternate members first appointed shall be for two years for Alternate No. 1 and one year for Alternate No. 2 so that the term of not more than one alternate member shall expire in any one year. A vacancy occurring other than by expiration of term shall be filled for the unexpired term only.

There is hereby established within the Borough of Ramsey the Mayor and Council's Americans With Disabilities Act Advisory Committee/Ramsey Is For Everyone (RIFE).
The Mayor and Council's Americans With Disabilities Act Advisory Committee shall consider, deal with and provide advice and counsel to the Mayor and Council of the Borough of Ramsey as to the concerns of disabled persons, barrier-free facilities, recreational opportunities, employment practices and the like and general and specific compliance with the requirements of the Americans With Disabilities Act and any appropriate legislation dealing with the subject matter thereof.
a. 
The Mayor and Council's Americans With Disabilities Act Advisory Committee shall be constituted to meet at least quarterly, shall by a majority vote select a Chairman to serve for a one-year period, such selection to be made each year and shall act pursuant to bylaws to be created by the Committee and adopted by a majority vote thereof within 90 days from the formation of the Mayor and Council's Americans With Disabilities Act Advisory Committee.
b. 
The record of proceedings of Committee meetings shall be kept, and such record, as well as any recommendations or advice of the Committee to the Mayor and Council, shall be provided to the Mayor and Council no later than 60 days after each meeting.
a. 
There shall be 11 members, of which five shall be persons with disabilities, or parents of a child with a disability, or a resident family member who is the caregiver of a person with a disability. Six members of the Committee shall be either residents of, or employed in, the Borough and shall be appointed by the Mayor, with staggered terms so as to result in the expiration of no more than three terms in any one year. Vacancies shall be filled for the remainder of an unexpired term.
b. 
The specific appointments to the aforesaid Committee shall be made by the Mayor for three-year terms, such appointments to be made within one month after the adoption of this chapter.
c. 
In making appointments, the Mayor may, but shall not be required to, consider representation from the following categories:
1. 
Liaison of the Mayor and Council;
2. 
Code enforcement;
3. 
Department of Public Works;
4. 
Recreation Commission;
5. 
School district;
6. 
Building Department;
7. 
Emergency services (police, fire, etc.);
8. 
Member of the business community;
9. 
Risk Manager;
10. 
Office of Emergency Management.

There is hereby created a permanent Board of Assessors to make all assessments for benefits accruing from local improvements in the Borough pursuant to N.J.S.A. 40:56-21.

The Board shall consist of three members who are residents of Ramsey, two of whom shall constitute a quorum.

Such Board shall make such assessments following the procedures for all local improvements set forth in N.J.S.A. 40:56-21, etc., as amended and supplemented.

The members shall receive such compensation for their services, as the Borough Council may fix and determine by resolution for each local improvement.

A Board of Public Works is hereby created to operate the water and sewer systems of the Borough and any other public utility authorized by law pursuant to the provisions of N.J.S.A. 40:89-1 and N.J.S.A. 40A:60-8.1.

The Board of Public Works shall consist of the Mayor and six residents of the Borough, who shall be appointed and serve as provided in N.J.S.A. 40:89-2.

The Board shall have all of the powers, authority, rights and privileges, and shall have imposed upon them the duties vested in or imposed upon the Mayor and Council relating to the maintenance and operation of a system of waterworks and water supply, and other utilities, as provided in N.J.S.A. 40:89-3 and N.J.S.A. 40A:60-8.1.

There shall be established in the Borough a Board of Health in accordance with the New Jersey Statutes Annotated and the amendments and the supplements thereto, applicable to local boards of health.

The Board of Health shall consist of seven members. Terms of the members shall be staggered so that not more than three members' terms expire in any year. All members of the Board shall be appointed by the Mayor with the advice and consent of the Council for three-year terms except in the case of a vacancy which shall be filled for the unexpired term only.

The Mayor with the advice and consent of the Council may appoint alternate members pursuant to N.J.S.A. 26:3-3. Alternate members shall be designated at the time of appointment by the authority appointing them as "Alternate No. 1" and "Alternate No. 2". The term of the alternate member shall be for two years, except that the terms of the alternate members first appointed shall be two years for Alternate No. 1 and one year for Alternate No. 2 so that the term of not one more than one alternate member shall expire in any one year. The vacancy occurring otherwise than by expiration of term shall be filled by the appointing authority for the unexpired term only.

The Board of Health shall adopt rules and regulations for its own government and shall elect a President from among its own members.

The Board of Health shall appoint a Registrar of Vital Statistics, Secretary, Health Officer, and Sanitary Inspector, and may also appoint such other officers, assistants or employees as the Board of Health may deem necessary. All appointees of the Board of Health shall be governed by the rules of the Board, and they may be removed for cause by the Board.

The Board of Health shall not contract any debts of any kind beyond the amount of the appropriation made for its use by the Council.

Pursuant to and in accordance with provisions of N.J.S.A. 40:12-1, et seq., there is hereby created a Board of Recreation Commissioners, the members of which shall be appointed in accordance with the provisions of N.J.S.A. 40:12-1 and 40:12-1.1.

The Board shall consist of seven members who shall be designated Commissioners. The Board shall also have two alternate members who shall be designated at appointment as "Alternate Commissioner No. 1" and "Alternate Commissioner No. 2."

If two alternates are appointed, their terms shall be staggered by the appointment of one of the alternates for an initial term that is a year less than a regular term.

The Board of Recreation Commissioners shall receive such annual appropriation as shall be provided for by the Council in its budget for the purpose of administration, maintenance and construction necessary to the system.

The Borough of Ramsey Fine Arts Council shall consist of seven members. Terms of the members shall be staggered so that not more than three member's terms expire in any year. All members of the Ramsey Fine Arts Council shall be appointed by the Mayor with the advice and consent of the Council for three-year terms, which shall expire on December 31, or until such time as their succession shall be appointed. All members of the Fine Arts Council shall be residents of the Borough of Ramsey and shall serve without compensation. Vacancies upon the Fine Arts Council shall be filled in the same manner as the original appointment, and any such appointment shall be for the remainder of the unexpired term only.
b. 
The Mayor with the advice and consent of the Council may appoint two alternate members of the Fine Arts Council. Alternate members shall be designated at the time of appointment by the Mayor as "Alternate No. 1" and "Alternate No. 2." The term of the alternate members shall be for two years, except that the terms of the alternate member first appointed shall be two years for Alternate No. 1 and one year for Alternate No. 2 so that the term of not more than one alternate member shall expire in any one year. A vacancy occurring other than by expiration of term shall be filled for the unexpired term only.

The Fine Arts Council shall serve in an advisory capacity to the Mayor and Council. The members of the Fine Arts Council shall elect from among its members a Chairman and a Vice Chairman and other officers which it deems appropriate. The Fine Arts Council shall utilize parliamentary procedures and establish bylaws for the orderly conduct of its meetings. The bylaws and any amendments thereto shall be subject to the review and approval of the Borough of Ramsey governing body. Four members of the Fine Arts Council shall constitute a quorum for the transaction of business. The Fine Arts Council shall keep minutes of its proceedings, showing the vote of each member upon each question, or if absent or failing to vote, indicating such fact. Meetings of the Fine Arts Council shall be scheduled by it and shall be held on a regular basis and at least quarterly. All meetings of the Fine Arts Council shall be held in compliance with the New Jersey Open Public Meetings Act (N.J.S.A. 10:4-6 et seq.).

The governing body of the Borough of Ramsey may choose one of its members to be liaison to the Fine Arts Council.

The Fine Arts Council shall have the following powers and duties:
a. 
To promote, coordinate and present quality visual and performing arts events for residents of all ages in conjunction with the Borough of Ramsey governing body;
b. 
To serve in an advisory capacity to the Borough of Ramsey governing body for the purpose of making recommendations regarding proposed projects;
c. 
To engage in and encourage cultural and artistic exhibitions, events and related activities;
d. 
To appoint subcommittees in special areas of dance, art, theater, and cultural heritage, etc. from the general citizenry of the Borough of Ramsey;
e. 
To make recommendations regarding any work of art to be acquired by the Borough whether by purchase, gift or otherwise, and to indicate and supervise its proposed location;
f. 
To recommend the removal, relocation, or alteration of any existing work of art in the possession of the Borough;
g. 
To examine all works of art located in the Borough and to make recommendations to the Borough governing body regarding Borough owned works of art;
h. 
When authorized by the Borough governing body, to advertise, prepare, print and distribute books, maps, charts, plans, and pamphlets which it deems necessary for its purpose;
i. 
When authorized by the Borough governing body, to apply for any grants appropriate for its purposes.

The Borough may appropriate such funds as it deems necessary for the administration, functioning and activities of the Fine Arts Council.
