Ch. VII of the 1975 Code]
Whenever any words and phrases are used in this
chapter, the meanings respectively ascribed to them in Subtitle I
of Title 39 of the Revised Statutes of New Jersey shall be deemed
to apply to such words and phrases used herein.
Whenever certain hours are named in this chapter,
they shall mean either Eastern standard time or Eastern daylight saving
time as may be in current use in the Township.
7-3.1.
Regulations not exclusive. The provisions of this
chapter imposing a time limit on parking shall not relieve any person
of the duty to observe other more restrictive provisions prohibiting
or limiting the stopping, standing or parking of vehicles as set forth
in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter
provided.
7-3.2.
Parking prohibited during state of emergency.
a.
Upon the declaration of an emergency, there shall
be no parking upon streets or sections of streets where temporary
EMERGENCY NO PARKING signs are displayed. The Chief of Police or,
in his absence, the ranking police officer is authorized to declare
an emergency and to direct the posting of EMERGENCY NO PARKING signs
when weather conditions, accidents, fire, public celebrations, etc.,
dictate or require the avoidance of hazards or other conditions which
interfere with the free flow of traffic. Notification that EMERGENCY
NO PARKING signs are being or will be posted shall be given to the
operator or owner of any vehicle which has been parked prior to the
posting of the signs.
b.
Any unoccupied vehicle parked or standing in violation
of this section shall be deemed a nuisance and menace to the safe
and proper regulations of traffic, and any police officer may provide
for the removal of such vehicle. The owner shall pay the reasonable
costs of removal and storage which may result from such removal before
regaining possession of the vehicle.
c.
The effectiveness of this section is contingent upon
the signs being erected as required by law.
7-3.3.
Parking prohibited at all times on certain streets.
No person shall park a vehicle at any time upon any of the streets
or parts thereof described in Schedule I below.

Enforcement officials. Any member of the Lower Township
Police Department is hereby empowered to enforce the provisions of
this section.
7-3.11.
No parking – secondary school zone. No student enrolled in a secondary school in the Township of Lower shall park a vehicle on a public street, road or highway within a radius of 1,000 feet of any property owned by or leased to the secondary school or school board in which such student is enrolled and which is used for school purposes during school hours. This includes, without limitation, the Lower Cape May Regional High School and any other secondary school which may, in the future, exist within the Township of Lower. For the purposes hereof, the one-thousand-foot boundary around secondary school property shall be the same area with respect to any such secondary schools as the drug-free school zone and the maps on file with the Lower Township Clerk in connection therewith pursuant to the provisions of Chapter 278, Drug-Free Zones, of the Code of the Township of Lower.

Valet parking regulations.

VALET PARKING
VALET PARKING ATTENDANT
Definitions.
The act of taking a vehicle from the street whether or not
a fee is charged and parking it on private property, in a private
parking lot, or in a privately owned parking garage for the vehicle
operator. Parking private vehicles via a valet service in a legal
on-street parking spot, within the public right-of-way, or in any
municipally/publicly owned location is prohibited.
An individual employed by a private commercial establishment
who, through its agents and employees, provides the service of valet
parking for customers/patrons of the establishment.
b.
Restrictions.
(a)
Valet
parking shall be confined to private property, in a private parking
lot, or in a privately owned parking garage.
(b)
Commercial
establishments providing valet parking services, and their valet parking
attendants, shall be prohibited from parking customers/patrons vehicles
in a legal on -street parking spot, within the public right-of-way,
or in any municipally/publicly owned location.
7-4.1.
Trucks over four tons excluded from certain streets.[1] Trucks over four tons' gross weight are hereby excluded
from the streets or parts of streets described in Schedule V except
for the pick up and delivery of materials on such streets. See Schedule
V below.

to 6:00 a.m.). No person shall park a vehicle over four tons' gross
weight on any street between the hours of 12:00 midnight and 6:00
a.m.
b.
No automobile occupied by any person shall be permitted
to be parked on any street, alley, public right-of-way, or public
parking lot in the Township between the hours of 12:00 midnight and
6:00 a.m., prevailing time.
c.
Penalty. Every person convicted of a violation of
this section shall be liable to a penalty not exceeding $500 or imprisonment
for a term not exceeding 15 days, or both.

Unless another penalty is expressly provided
by New Jersey statute, every person convicted of a violation of a
provision of this chapter or any supplement thereto shall be liable
to a penalty of not more than $50 or imprisonment for a term not exceeding
15 days, or both.
All former traffic ordinances of the Township
of Lower covered in this Traffic Chapter are hereby repealed except
that this repeal shall not affect or prevent the prosecution or punishment
of any person for any act done or committed in violation of any ordinance
hereby repealed prior to the taking effect of this chapter.

Pursuant to N.J.S.A. 40:67-16.1, the streets

route for trucks and buses over four tons. All trucks and buses having
a total combined gross weight of vehicle plus load in excess of four
tons shall be excluded from all streets, except from those streets

7-15.1.
Findings. The Township Council of the Township of
Lower finds that the closure of municipal streets during block parties
and holiday celebrations is necessary for the preservation of public
health, safety and welfare of the Township's residents.
7-15.2.
Closure of public streets. The Chief of Police or
his designee may authorize the closure of any municipal street or
portion thereof to motor vehicle traffic on any day or days or during
specified hours on any day or days for block parties and holiday celebrations
whenever the Manager finds that such closing is necessary for the
preservation of the public safety, health or welfare.
7-15.3.
Advanced notice of street closure. Whenever a street
is to be closed for any such reason, either continuously or during
certain hours, to vehicular traffic for a period of 48 hours or more
necessitating the interruption of the flow of traffic, the Township
shall cause the erection and maintenance of signs at or near the affected
area at least 72 hours in advance of the closing. Such signs shall
name the municipal roadway or street to be closed and the anticipated
dates and times of closing.
