No person shall drink, imbibe or consume any
alcoholic beverage on any public sidewalks or streets, alleys or roadways
in the Village of Millerton.

No person shall drink, imbibe or consume alcoholic
beverages in any park in the Village of Millerton without securing
a permit from the Village Board. Said permit shall include the name,
address and telephone number of the entity requesting the permit,
and the time, place and purpose for which the permit is requested.
No permit will be granted unless the application is accompanied by
a certificate of insurance naming the Village of Millerton as additional
insured.
No person shall drink, imbibe or consume any
alcoholic beverage in any vehicle on any public streets, alleys or
roadways in the Village of Millerton.
No person shall throw or discard any bottle,
can or container, empty or otherwise onto any public street of the
Village of Millerton.

Any person violating any of the provisions of
this chapter shall be guilty of an offense and shall, upon conviction
of such violation, be liable to a fine of not more than $250, imprisonment
for a term not exceeding 15 days, or to both such fine and imprisonment.

The Village Board may grant a waiver from the general prohibition
against public consumption of alcohol contained in this chapter in
the case of appropriate special events. Such waiver may be granted
by the Village Board in the exercise of its sole discretion, upon
making a determination that the requested waiver is consistent with
the public health, safety and welfare of the residents and property
owners of the Village. The sponsor of a special event seeking such
a waiver must make advance written request for that waiver. This advance
written request must include a statement that the special event is
open to the general public. This advance written request must also
be accompanied by proof that the event sponsor has obtained liability
insurance in form and amount acceptable to the Village Board naming
the Village as an additional insured on a primary and noncontributory
basis. The Village Board shall be entitled to grant such a waiver
by resolution.
