Wherever it appears that a project will cause the destruction, disturbance, damage or removal of permanent geodetic control points, peripheral survey points or any other geodetic survey control points which are part of the Town's control network, the record owner, developer or legal representative of the parcel of land where the control point(s) lies shall provide the Engineer 60 days' advance written notice. This notification shall be in written letter form and sent without delay as soon as the record owner becomes aware of the apparent control point destruction. It shall be the responsibility of the record owner to conform with the all procedures of Article III, Preservation Requirements.
A. 
It shall be unlawful for any person, firm or corporation to violate any provision of this chapter or to fail in any manner to comply with a notice, directive or order of the Engineer or Commissioner of Building or his representative issued pursuant to this chapter.
B. 
Any person having been served with a directive from the Engineer or Commissioner of Building, pursuant to the provisions of this chapter, who shall fail to comply with the directive within 30 days after such service or within the time fixed by the Engineer or Commissioner of Building for compliance shall be guilty of a violation of this chapter and shall be punishable by with a fine not exceeding $250 or imprisonment for a period not to exceed 15 days, or both. Each week of continued violation shall constitute a separate violation.
