GENERAL REFERENCES
Peddling and soliciting — See Ch. 156.
It shall be unlawful for anyone to organize,
hold, or participate in a parade or procession of any kind unless
a permit has been issued for the parade or procession.
A.
General rule. An application for a permit shall be
submitted to the Township Secretary or Manager, as the case may be,
or other designated Township official, and shall contain the following
information:
(1)
The name and address of the sponsor of the parade
or procession, the names and addresses of at least two of the principal
officers or principals of the sponsor, and the name and address of
the person designated by the sponsor to be in charge of the parade.
(2)
The purpose of the parade or procession.
(3)
The proposed date, time, duration, and route of the
parade or procession, as well as any special traffic considerations
or needs, police or fire police protection, or any other matters which
will require action by the Township Board of Supervisors. This information
shall be provided at least 60 days prior to the proposed date of the
parade or procession.
(4)
The anticipated number of participants in the parade
or procession.
B.
Fee. The Township Board of Supervisors is hereby authorized
to set such fees for permits under this chapter by resolution as it
shall from time to time deem appropriate.[1] The Township Board of Supervisors shall also have the
right and the option to waive the payment of fees otherwise due under
this chapter for nonprofit or charitable groups, in its sole discretion
and on a case-by-case basis.

Approval of the permit shall be granted in the
sole discretion of the Township's Board of Supervisors at a regularly
scheduled meeting. In considering the application, the Board of Supervisors
shall consider the special needs of the applicant as set forth in
the application or as shall be determined to be required. As part
of any approval, the Board of Supervisors shall fix the date, time,
duration, and route of the parade or procession, which shall be set
forth in the permit.
The sponsor shall be responsible for all costs
associated with the parade or procession, including, but not limited
to, police and fire protection, damage to persons and property, and
cleanup. The Board of Supervisors shall have the option to waive any
and all of those costs in their sole discretion.
As a condition of issuing the permit, unless
waived by them in their sole discretion, the Board of Supervisors
shall require the sponsor to obtain liability insurance and/or post
a surety bond to cover the costs of police and fire protection, personal
injury to participants, spectators and bystanders, damage to property,
including Township property, and cleanup. The liability insurance
and/or security bond shall be in such amount as the Board of Supervisors
reasonably believes to be necessary to cover the anticipated costs
and liability. Such liability insurance and/or surety bond shall be
provided by no later than the meeting of the Board of Supervisors
immediately before the scheduled date of the event, and shall be posted
to the satisfaction of the Township before the permit is issued.
A.
Weapons. No functional firearm or other weapon may
be carried by participants in a parade or procession, unless specifically
authorized in the permit.
B.
Animals. Any animals in a parade or procession must
be followed by a cleanup crew, which shall immediately clean up any
droppings.
C.
Flags, banners, signs. The permit may restrict the
size and manner of construction of flags, banners, signs and similar
devices. Whether restricted by permit or not, no flags, banners, or
signs shall be of such a size, shape, or design as to interfere with
any signs, wires, light posts, or other such devices which are adjacent
to or overhang the parade route.
D.
Parades for commercial purposes. Parades and processions
having as their sole or principal purpose the advertisement or promotion
of a product or service are prohibited.
A.
Denial. The Board of Supervisors may deny issuance
of a permit under the following circumstances:
(1)
If any required information is not provided in the
permit application or is determined to be untrue, inaccurate, or misleading;
or
(2)
If it determines that the size or nature of the parade
will disrupt to an unreasonable extent the movement of traffic or
the public health, safety or welfare, or will require a greater number
of police officers than are available to the Township; or
(3)
The proposed parade or procession does not meet the
requirements of this chapter.
B.
Cancellation. The Board of Supervisors, Secretary
or Manager of the Township, or Chief of the Police Department having
jurisdiction in the Township may cancel a permit, parade or procession,
or stop a parade or procession, for the following reasons:
Any person violating any of the terms of this chapter shall, upon conviction before a Magisterial District Judge of such violation in a summary proceeding, be subject to a fine not to exceed $1,000, together with all costs as permitted by law, or, in the event of failure to pay such fine, imprisonment in the York County Prison for a term not to exceed 90 days. As used in this section, the term "person" shall mean any individual, partnership, association, corporation, sponsor, or officer or principal of a sponsor named in or designated by the permit as set forth in § 151-2A(1).
