No person, firm or corporation shall hereinafter construct, build, establish or maintain any driveway or private egress or ingress onto private lands from any public highway of East Manchester Township or entrance onto any such highway from private lands without first having obtained a written permit to do so from the Secretary of East Manchester Township and without first obtaining a building permit and without first obtaining a sewage permit, where applicable to the work contemplated on such property. No such permit shall be issued for the construction, establishment or maintenance of any such driveway except in accordance with provisions herein contained.
Any person, firm or corporation desiring to establish or construct an entrance onto a public road of the Township as referred to in § 203-7 hereof shall file with the Secretary of the Township a written application for the establishment thereof. Such application shall set forth the exact location of the driveway or entrance so to be constructed or established, the grade of the same to or from the public road as related to the private land which shall be connected thereby to the public road, the existing surface drainage, the material with which the public road is presently surfaced and the material with which the proposed driveway or entrance is to be surfaced. The applicant shall, in addition, provide such other and further information as the Secretary shall require for the intelligent consideration of the application.

Before any work shall be started and before said permit shall be issued, the applicant shall pay to the Township an inspection fee for all new construction and a resurfacing fee as set forth from time to time by the Board of Supervisors.[1]

Upon receipt of such application and payment of fees as provided for herein, the Secretary shall refer said application to the Township Roadmaster or Township Engineer for inspection and recommendation.
All plans and specifications must conform to those requirements which the Township Engineer from time to time may deem appropriate and as are more fully set forth in a standard layout prepared by the Township Engineer. A copy of said plans and specifications and standard layout shall be available at the Township office, and a copy of which shall be given to the applicant upon his/her making application pursuant to § 203-8 herein.

The widths of the driveways for residential or dwelling houses shall not be less than nine feet nor more than 25 feet at the outer or street edge of the driveway where it intersects with any roadway.
The Board of Supervisors shall receive the recommendation of the Township Roadmaster or Engineer, which shall be advisory, and if, in its discretion, it appears that the driveway, as proposed, may be established with due regard to the safety of the pedestrians and vehicular traffic and with regard to the drainage condition then in existence or as contemplated, the permit to establish or construct or alter the driveway shall be issued; otherwise, such application shall be denied.
The Board of Supervisors shall, in its discretion, have the right to reject any application or any part thereof and to require the applicant to comply with any standards or provisions which it may, in its sole discretion, deem to be necessary for the protection of the health, safety or general welfare of the residents of the Township for vehicular traffic.

Any person who violates any provisions of this article shall commit a criminal offense, and shall, upon being found guilty by a Magisterial District Judge, after hearing, pay a fine not to exceed $1,000, together with all court costs as permitted by law. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day of violation shall constitute a separate offense, which shall be subjection to prosecution as such. For purposes of this section, the Board of Supervisors of East Manchester Township hereby appoints the Township Manager, Secretary, Zoning Officer, Permit Officer or Codes Enforcement Officer as authorized representatives, any one of whom may commence and pursue enforcement proceedings pursuant to this section.
