All departments, offices and agencies under the direction and supervision of the City Administrator shall be administered by an officer appointed by and subject to the direction and supervision of the City Administrator except as otherwise provided in this Charter. With the consent of the City Council, the City Administrator may serve as the head of one or more such departments, offices or agencies except the Police and Fire Departments, or may appoint one person as the head of two or more of them, except the Police or Fire Departments.

The City Council, by ordinance, may create, change, and abolish offices, departments and agencies, other than the offices, departments and agencies established by state statute. The City Council, by ordinance, may assign additional functions or duties to offices, departments or agencies established by state statute, but may neither discontinue nor assign to any other office, department or agency any function or duty assigned by state statute to a particular office, department or agency.

There shall be an administrative code adopted by the City Council.[1] The administrative code may be revised and amended as necessary and within nine (9) months of the adoption of this Charter the City Council shall revise the present administrative code to bring it into compliance with this Charter. The administrative code shall establish the departmental organization and the functions of the various departments, offices, and agencies of the City and shall not be inconsistent with provisions of this Charter.

The City Council shall adopt a personnel ordinance to carry out the purposes of this Article.[1] The personnel ordinance shall not affect the City Administrator; the City Solicitor; elected officials; members appointed to committees, commissions or boards; or any city employee whose relationship with the City is governed by means of a contract executed under the authority of the Municipal Public Employees Labor Relations Law.[2] The personnel ordinance shall establish a grievance procedure. Procedures authorizing the suspension, discharge, or removal from permanent office or employment shall require just cause and a public hearing.

There shall be a City Solicitor who shall be appointed by the City Administrator and confirmed by the City Council. The City Solicitor shall serve at the will of both the Mayor and the City Council. The City Solicitor shall serve as chief legal advisor to the Mayor and the City Council, the City Administrator, and all City departments, boards, agencies, committees and commissions. The City Solicitor shall represent the City in legal proceedings and shall perform any other duties prescribed by ordinance and law. The City Council shall have the right to employ or retain special attorneys, if it deems it to be in the best interests of the City.
