[Adopted 6-9-1987 by Ord. No. 7-87 (Ch. 71, Art. III, of the 1985 Code)]
As used in this article, the following terms shall have the meanings indicated:
CONSUMPTION OF ALCOHOLIC BEVERAGES
Drinking or possession of open containers of any alcoholic beverages, as defined by the Revised Statutes of the State of New Jersey, in such public places, including public buildings or their premises, streets, roads, alleys, avenues and sidewalks.
The consumption of alcoholic beverages, except as otherwise provided in § 113-21, is hereby prohibited on public streets in the Central Business Historic District, as defined in Chapter 96, Zoning, including roads, alleys, avenues and sidewalks and in and about public buildings and their premises surrounding them.
Notwithstanding any provisions contained herein to the contrary, block party permits or resolutions authorizing block parties or events in the public parks which shall include the right to possess or consume alcoholic beverages, where such permission is granted by the Commissioner for Streets and Public Property, shall not be deemed violative of this article.

A. 
Any violation of this Article III shall be punished as provided in Chapter 1, General Provisions, Article II, General Penalty. Any person who is convicted and fined for violating the same ordinance within one year of the date of a previous violation of said ordinance shall be subject to an additional fine as a repeat offender. The additional fine shall be calculated separately and in addition to the fine imposed for violating the ordinance.[1]

B. 
In addition to the fine authorized for this offense, the court may suspend or postpone the driving privilege of the defendant, in accordance with the provisions set forth in Title 39 of the New Jersey Statutes Annotated.
