This article shall be known and may be cited as the "Curbside and Trash Collection Ordinance" of the Village of Ridgefield Park.
This article is adopted in order to promote and protect the public health, safety and welfare of the residents of the Village of Ridgefield Park and, in addition thereto, to protect property, preserve property values and eliminate fire, safety and health hazards by regulating the collection, storage and disposal of garbage and trash within the Village of Ridgefield Park.
A. 
It shall be the duty of every owner, tenant, agent, lessee or occupant of every dwelling and other premises within the limits of the Village of Ridgefield Park to provide or cause to be provided and to keep on the premises at all times suitable metallic or synthetic containers or plastic trash bags designed for combined trash and garbage disposal.
B. 
The following regulations shall govern the use of containers within the limits of the Village of Ridgefield Park:
(1) 
A complying household container for the purpose of this section must be of a watertight type, with a tightly fitted cover, so constructed as to prevent spilling or leakage of its contents. Such containers and covers shall have adequate handles and be of a size to permit ease of handling by one person.
(2) 
Plastic or metallic chemical barrels or steel drums shall not be used and are not suitable containers.
(3) 
All plastic trash bags must be at least three-mil strength to prevent breakage and spillage of contents. Their capacity shall not be more than one bushel to permit handling by one person. The filled weight should be no more than 30 pounds and they shall be securely fastened by a twist tie to avoid spillage and escape of odors and to avoid attracting rodents, insects and other vermin.
(4) 
An adequate number of containers shall be provided to hold all trash and garbage which accumulates on the premises between periods of removal. No garbage or trash shall extend beyond the top of the container. All containers shall be conveniently located on the premises in such a manner as to prevent creation of a nuisance or menace to the public health of residents. (See § 214-23.)
(5) 
All containers that are badly broken or otherwise fail to meet the requirements of this section shall be promptly removed and replaced. Any noncomplying containers will be considered trash and removed from the curb by the sanitation crew, including those that leak or are collapsed or flattened to the extent that they restrict the removal of the contents.
(6) 
Large portable containers.
(a) 
All larger portable containers normally used by apartment complexes or commercial establishments shall have a maximum capacity of no more than two yards and shall be equipped with attached covers and four wheels and be designed to be compatible with the lifting equipment on the Village sanitation trucks. These containers shall only be used after permission has been received from the Superintendent of Public Works.
(b) 
The two-yard containers shall be located for easy access by sanitation crews but in an appropriately screened area when they are not being picked up.
(c) 
The pad or area to house the containers shall be paved with concrete. The pad shall be large enough not only to house the containers but to be able to maneuver them to and from the street for collection crews.
(d) 
There shall be a curb cut directly opposite the container pad to house a concrete apron to the level of the street. There shall be a concrete sidewalk between the pad and apron.
(e) 
All surfaces from the pad to the street shall be smooth with no cracks or severe changes in elevation to restrict movement of the containers from the pad to the adjacent street for collection.
(f) 
All containers shall be screened from public view in accordance with the Property Maintenance Code and Zoning Code.[1]

(7) 
All container pads, sidewalks and aprons and all curbside areas where garbage containers will be placed for pickup shall be kept free and clear of accumulations of snow or other obstructions that would restrict their removal by sanitation crews. The entire area where garbage cans and containers are stored shall be kept free of all garbage, trash and litter on a continual daily schedule. The owner or tenant of the property shall ensure that adequate containerization is provided to prevent this from happening. Violators shall be subject to fines on each day during violations.

(8) 
Garbage will not be picked up by the Village if the containers are snowed in. The occupant shall remove the container from snow and place it back at the curb on the next scheduled pickup day.
(9) 
No individual shall place out for collection any garbage in paper bags, boxes or other noncomplying containers under any circumstances.

A. 
The following regulations shall govern the storage, placement and collection of garbage and trash generated or otherwise created within the Village of Ridgefield Park. Combined garbage and trash collections will be furnished by the Village of Ridgefield Park to all qualifying premises within the Village. Garbage will be collected curbside twice per week and limited trash pickup curbside once per month on days designated by resolution issued by the Board of Commissioners of the Village of Ridgefield Park entitled "Garbage and Trash Collection Schedule."
B. 
Under the terms of this article, "garbage" is defined as that which is generated within a kitchen, bath, bedroom or office and will fit into a standard kitchen waste container. Everything else is trash.

A. 
The Department of Public Works will not pick up garbage or trash on weekends or on the following holidays:

Lincoln's Birthday
Presidents Day
Good Friday
Memorial Day
Independence Day
Labor Day
Columbus Day
Election Day
Veterans Day
Thanksgiving Day
Christmas Day
B. 
Designated locations for placement of any and all waste items for pickup by the Public Works crew is curbside in front of the premises where waste was generated. All premises within the Village shall use the system of garbage and trash placement and collection in accordance with these regulations or such regulations adopted by the Board of Commissioners by resolution.

A. 
Whenever trash is placed next to garbage on Thursday (north of Mt. Vernon Street) and on Friday (Mt. Vernon Street and south), a trash sticker will be attached to one of the trash items placed at the curb to permit removal by the sanitation crew.
B. 
If a single bag, bundle or item or several are placed at curbside, a single sticker must be attached to one of the items for that day.
C. 
Each household within the Village who qualifies for a sanitation pickup shall receive 10 stickers per year for attaching to trash. Additional stickers can be secured at the Public Works Office at a cost of $10 per sticker.
D. 
If a sticker is not present, the trash will not be removed.
Permitted materials shall be as follows:
A. 
Garbage, including but not limited to decomposable solid animal and vegetables wastes resulting from the handling, preparation, cooking and consumption of food, all table refuse, office and bedroom basket waste.
B. 
Trash, including but not limited to nondecomposable solid wastes consisting of contaminated paper, yard clippings, wood, crockery, metal, furniture, small appliances and similar materials (no leaves or grass clippings).
C. 
Ashes, including but not limited to the residue from the burning of wood, coal, coke or other combustible materials.
D. 
Vegetation.
(1) 
Trees, tree branches, pieces of wood or logs over two inches in diameter shall be cut to lengths no longer than 36 inches and placed at the curb for pickup.[1]

(2) 
Vegetation, tree branches, logs or yard trimmings will not be picked up or accepted from November 1 to April 1 each year due to equipment being geared for winter operation.

The following refuse shall not be considered acceptable for collection by the Village of Ridgefield Park:
A. 
Dangerous materials or substances such as poison, acids, caustics, noxious chemicals, infected materials, explosives, ammunitions, radioactive materials, toxic chemicals, dry-cleaning fluids and filters or any other materials likely to cause injuries to persons employed or damage to equipment used in making collections shall not be considered acceptable. No liquids shall be accepted except those listed under § 214-22B.
B. 
All building materials, whether new or old, resulting from construction, renovation, alteration or demolition of a house, garage, storage shed or other type of building, including but not limited to all lumber, roofing materials, plasterboard, siding, lath, plaster, windows, doors, trim, flooring, cabinets, stairs, heating system materials, plumbing and electrical supplies, brick, block, gravel, clean fill, etc., generated by the owner or tenant of any dwelling personally doing his own work, with no contractor involved, will not be accepted for pickup by the Public Works Department. Arrangements must be made to dispose of these items privately at the cost of the owner or tenant.
C. 
All building materials as listed in Subsection B above, accumulated by a private contractor, including waste from yard maintenance and landscaping, tree removal, driveways, sidewalks or patios or pool buildings, shall be removed by said contractor from the premises and disposed of privately at the cost of the owner or tenant.
D. 
Contractors, owners and/or tenants shall be responsible for the disposal of materials mentioned in Subsections A and B above, subject to the acquisition of a special permit as described in § 214-26.
E. 
A landscaper, contractor or any other individual who uses a power blower, rake, broom or other tool to blow or place yard rakings from any premises within the Village of Ridgefield Park onto the sidewalks, streets or other public rights-of-way within the Village of Ridgefield Park shall pick up and remove said yard rakings from said sidewalks, streets or other public rights-of-way.
F. 
All concrete generated by an occupant or owner from demolition, renovation, alteration or new construction shall not be considered acceptable.
G. 
All large quantities or unusual amounts of household debris, such as attic, basement, garage or house and/or apartment cleanout at the time the house and/or apartment is changing occupant or owner shall not be considered acceptable. All decisions as to large quantities or unusual amounts shall be made by the Superintendent of Public Works or his designee.
H. 
All materials or waste generated by a commercial or business establishment which is a by-product or excess from its daily manufacturing, processing or operation shall be classified as trade waste and shall not be acceptable for pickup by the Public Works Department of Ridgefield Park. Disposal shall be done privately with costs borne by the owner or tenant.
Trash and garbage will be disposed of only in accordance with standards established by the State Department of Health and the Environmental Protection Agency and maintained in accordance with the Solid Waste Management Act of New Jersey (N.J.S.A. 13:1E-1 et seq.).
No person, other than an authorized employer or agent of the Department of Public Works of the Village of Ridgefield Park or a private scavenger licensed or duly authorized by the appropriate authorities or a civic or fraternal organization located in Ridgefield Park, shall disturb or remove any garbage or trash placed at the curb by the owner, agent, lessor, tenant or occupant for removal, unless:
A. 
Expressly requested by the resident of said premises; or
B. 
With permission of the Department of Public Works.
A. 
All garbage and trash shall be thoroughly and completely drained of all liquids before being placed in complying containers.
B. 
Acceptable liquid wastes, such as paints, paint solvents, etc., limited to one-gallon containers, will be contained separately, marked clearly as to contents and placed at the curb to be easily distinguished by the collector.
C. 
Branches or pieces of wood less than two inches in diameter, yard clippings and all other forms of vegetation shall be cut into lengths not exceeding four feet and tied into bundles which can be readily handled by an individual collector.
D. 
Tree stumps shall be cut into pieces no larger than can be handled by one man and placed at the curb for pickup. Full stumps will not be accepted.
E. 
Tree droppings and yard sweepings are not to be dumped, laid, cast or thrown into the street in a loose condition, but bagged or placed in a proper container.[1]

F. 
At no time will tree droppings, branches or trash be placed on street plazas, parks or other public property.
For collection pursuant to a schedule announced by the Commissioner in charge of the Department of Public Works, all containers must be brought to and placed at the curbline for pickup where easily accessible. No containers shall be set out prior to 5:00 p.m. on the day prior to collection, and all containers shall be removed by 8:00 p.m. on the collection day. When a regular collection day falls on a legal holiday, containers shall not be set out until the next regularly scheduled collection unless special announcement of collection is made by the Village.
All recyclables, including but not limited to newspapers, aluminum cans, tin cans, plastic beverage bottles, glass bottles and jars, corrugated cardboard, white goods and any other recyclable items that may be added to this list in the future by the Board of Commissioners of the Village of Ridgefield Park, cannot be classified as solid waste under this article. They shall be controlled by the Recycling Ordinance[1] of the Village of Ridgefield Park.

The collection and disposal of garbage and trash shall be under the supervision of the Commissioner in charge of the Department of Public Works, who shall have the authority to make rules and regulations concerning the days of collection, the type and location of containers and such other matters pertaining to the collection and disposal as he may deem advisable, provided that such rules and regulations are not contrary to the provisions of this article. The Commissioners of the Board of Health and the representatives of the Board of Health shall, where appropriate, have the authority to enforce statutes, rules and regulations pertaining to disposal of trash and garbage and, in particular, where the disposal and the method employed by any person shall affect the public health, safety and welfare.
It shall be unlawful for any person or persons, other than the person or persons designated by and/or bound under contract to the Village of Ridgefield Park, to gather and remove any garbage or other vegetable and animal refuse within the limits of the Village of Ridgefield Park; except, however, that the private collection of garbage and other animal and vegetable matter may be collected by persons other than the parties with whom the Village of Ridgefield Park makes contact, provided that such private collector of other vegetable and animal matter or refuse not acceptable for collection as mentioned in § 214-19 shall receive a special permit therefor from the Board of Health of the Village of Ridgefield Park.
No person shall interfere or prevent any agent or employee of the Village of Ridgefield Park Department of Public Works in the discharge of his duties in the collection of garbage or trash or in the sweeping, plowing, salt spreading or cleaning of any sidewalks or street or in the removal of any trash, leaves, recyclables or other refuse material.
Any person, firm or corporation who shall violate any of the provisions of this article shall be punishable, upon conviction, as provided in Chapter 1, General Provisions, Article II, General Penalty.

The administration and enforcement of this article shall be the responsibility of the various officials of the Village of Ridgefield Park, including the Superintendent and Assistant Superintendent of the Department of Public Works, representatives of the Board of Health and the Police Department.
