No person shall obstruct any street, avenue
or other public place in the Village by materials placed thereon until
a written permit has first been obtained from the Building Department.
Any application for permits under this article
shall be made by the owner of the abutting property or by the general
contractor in charge of the work to be done under such permit.
Permits required by this article shall be issued
by the Building Department or the Construction Official or such other
proper officer or committee designated by the Board of Commissioners,
upon payment of a fee as per the fee schedule established by the Board
of Commissioners. Such permit shall remain in force and effect for
a period of 30 days from the date of issuance.
All obstructions shall be guarded at night by
two or more lights placed not more than 10 feet apart throughout the
length of such obstruction, which lights shall be kept burning from
sunset to sunrise.
No obstruction shall occupy more than 1/3 of
the width of the roadway of any street or avenue, nor shall any obstruction
be placed upon a sidewalk. The gutter shall be kept clean for at least
a width of two feet, and a safe passageway at least four feet wide
shall be provided for pedestrians.
In case flag sidewalks are taken up for the
purpose of allowing material to be delivered on the premises in front
of which the sidewalk is laid or for any other purpose, places from
which the flagging is removed shall be covered by planking, which
shall be firmly and smoothly laid so as to provide a proper and safe
passage for pedestrians. In the case of concrete sidewalks, bridgework
shall be constructed of planking so laid and supported that the planking
for such crossing shall be at least four inches above the concrete
or cement sidewalk, and in no case shall such bridgework be laid directly
upon or in close contact with the concrete sidewalk.

Any person, firm or corporation who shall violate any of the provisions of this article shall be punishable, upon conviction, as provided in Chapter
1, General Provisions, Article
II, General Penalty.
