It shall be unlawful to plant poplar trees or weeping willow trees along or in any street, highway, road or other public place, except public parks, within the Village. Only those species of shade trees listed as approved in §
96A-46 of the Development Regulations may be planted along or in any street, highway, road or other public place, except public parks, within the Village.
It shall be unlawful for any person to mutilate,
cut or injure the bark or limb of any shade tree or ornamental shrub
or bush, or otherwise injure any such tree, ornamental shrub or bush,
located upon or along any street, highway, sidewalk, plaza or other
public place in the Village, provided that nothing in this section
shall be construed to prohibit reasonable and necessary trimming of
trees, bushes and shrubbery.
It shall be unlawful for any person to tie or
fasten or suffer or permit to be tied or fastened any animal in his
ownership, possession or control to any shade tree or ornamental shrub
or bush on any street or public way in the Village or in any way to
cause or permit any animal in his ownership, possession or control
to gnaw, mutilate or otherwise injure any such tree, shrub or bush
or the bark or limbs thereof.
Any person who shall violate any of the provisions of this article shall be punishable, upon conviction, as provided in Chapter
1, General Provisions, Article
II, General Penalty.

The owners or tenants of lands within the Village shall keep all brush, hedges and other plant life growing within the sight triangle described in §
96-7.7 of the Code cut to the height required by said §
96-7.7.
The owners or tenants of land abutting or bordering upon the sidewalks or public streets and highways shall trim, prune and cut back all trees abutting or bordering upon sidewalks or gutters of public streets to the height required by §
96-7.7.
In cases where the owners or tenants of lands referred to in this article shall refuse or neglect to cut or trim such brush, hedges, trees or other plant life in the manner set forth in §§
368-5 and
368-6, the Chief of Police shall notify such owners or tenants to cut the same in the manner set forth in such sections within 10 days after such notice is given.
In addition to any other penalty imposed for
the violation of this article, in the event that owners or tenants
of lands within the Village refuse or neglect to cut or trim such
brush, hedges, trees or other plant life in the manner and within
the time provided in this article, the Chief of Police shall provide
for the cutting of the same under his direction. In cases where such
brush, hedges, trees or other plant life are cut or trimmed from or
on any lands within the Village as provided by this section, the Chief
of Police shall certify the cost thereof to the Board of Commissioners,
which shall examine the certificate and, if found correct, shall cause
the cost as shown thereon to be charged against such lands, or, in
the event that such cost is excessive, shall cause the reasonable
cost thereof to be charged against such lands. The amount so charged
shall forthwith become a lien upon such lands and shall be added to
and become and form part of the taxes next to be assessed and levied
upon such lands, the same to bear interest at the same rate as other
taxes, and shall be collected and enforced by the same officers and
in the same manner as taxes.
Any owner or tenant of land who shall violate any of the provisions of this article shall be punishable, upon conviction, as provided in Chapter
1, General Provisions, Article
II, General Penalty.
