Village of Montgomery, NY Article VIII Offenses

§ 96-40 Failure to comply.

It shall be a violation for any person to fail to comply with any of the provisions of this Part 1, including any order, rule, regulation, specification or requirement issued pursuant to or in furtherance of this Part 1.

§ 96-41 Prohibited practices.

A. No person shall discharge to any receiving waters within the Village or in any area under the jurisdiction of the Village any sewage, industrial waste or other wastes, except after providing treatment in accordance with the provisions of this Part 1 and other applicable local, state and federal laws.

B. No person shall discharge to any storm sewer within said Village or any area under the jurisdiction of said Village any sewage, industrial waste or other wastes.

C. No person shall make connection of roof downspouts, exterior foundation drains, areaway drains or other sources of surface runoff or groundwater to a building sewer or building drain which in turn is connected directly or indirectly to a Village sanitary sewer.

D. No person shall impede, obstruct, hinder or otherwise interfere with the Water and Sewer Board in the performance of its duties under this Part 1.

E. No person shall maliciously, willfully or negligently break, damage, destroy, uncover, deface or tamper with any structure, appurtenance or equipment which is a part of the Village disposal system.

F. No person shall make false, misleading or incomplete statements in any application for a permit or other approval or in any records required to be kept under this Part 1.

G. No person shall discharge any animal excrement to any storm sewer or Village sewer.

H. No person shall cause any connection to be made between a piping system carrying potable water and a piping system carrying, at any time, anything other than potable water.

I. No person, without the prior approval of the Water and Sewer Board, shall discharge or cause to be discharges to the Village sewer system any wastes generated outside the Village.

J. No sump pumps or any apparatus of the like shall be permitted to introduce wastewater into building sewers which in turn are connected directly or indirectly to a Village sanitary sewer.

§ 96-42 Continuing offenses.

Each day a violation continues shall constitute a separate violation.

§ 96-43 Responsibility of employers.

Nothing in this Part 1 shall be construed to relieve employers of responsibility for the conduct of their employees.
