Pursuant to N.J.S.A. 43:15C-2, the following positions are deemed eligible and shall participate in the Defined Contribution Retirement Program:
A. 
Township Council.
B. 
Township Manager.
C. 
Director of Recreation.
D. 
Director of Municipal Utilities.
E. 
Director of Public Works.
F. 
Director of Public Safety.
G. 
Superintendent of Public Works.
H. 
Superintendent of Utilities.
I. 
Municipal Prosecutor.
J. 
Public Defender.
K. 
Municipal Court Judge.
Individuals serving in the following positions are exempt from Defined Contribution Retirement Program membership, pursuant to N.J.S.A. 43:15C-2:
A. 
Building Sub Code Official.
B. 
Chief Financial Officer.
C. 
Construction Code Official.
D. 
Sub Code Officials.
E. 
Qualified Purchasing Agent.
F. 
Registered Municipal Clerk.
G. 
Tax Assessor.
H. 
Tax Collector.
Notwithstanding the above, individuals who are already enrolled in a Public Employees Retirement System (PERS) position may continue Defined Contribution Retirement Program their PERS position when serving in a Defined Contribution Retirement Program position as long as employment is continuously according to the law.
This article shall be implemented, construed and subject to the aforesaid Chapter 92 of the Laws of 2007 (N.J.S.A. 43:15C-1 et seq.), as amended from time to time, and any regulation or guidance documents from the Local Finance Board or the Division of Pension and Benefits.

This article shall be known as "Retirement, Article II, Post-Retirement Health Benefits."
The Township of Medford does hereby commit to assist employees of the Township by providing post-retirement health benefits as authorized by N.J.S.A. 40A:10-22 et seq. The Township Council recognizes and values the hard work and commitment of these Township employees. The Township Council also realizes that post-retirement health benefit costs are on the rise and, under the authority of N.J.S.A. 40A:10-22 et seq., implements this chapter to provide qualifying employees post-retirement health benefits.
A. 
The Township of Medford shall pay the entire cost of post-retirement health benefits for the retiree and his/her dependents only when the employee has worked 25 years or more in a state or locally administered retirement system and 20 continuous years or more of service with the Township of Medford. Post-retirement benefits includes Medicare reimbursement.
B. 
Post-retirement benefits is defined to only include medical benefits. Dental and vision are not a post-retirement health benefit.
A. 
An employee is not eligible for post-retirement health benefits under this chapter, if the employee is eligible, or becomes eligible, for health benefits under any other private, state or federal health benefits plan.
B. 
An employee is not eligible for post-retirement benefits under this chapter, if the employee is eligible, or becomes eligible, for health benefits under a spouse 's health plan at no additional cost to the spouse or the employee.
C. 
If the employee at retirement elects not to be covered by the Township and their lifestyle changes, such as a death of a spouse or divorce, which eliminates their eligibility from the Group Health Benefits Program, they are eligible to apply for benefits under the Township plan at that time. The employee must complete the necessary documents and forward them to the Township within 30 days of the lifestyle changes.
D. 
Post-retirement health benefits shall cease at the employee's death to any dependants, including the employee's spouse.
