The Town Manager shall be chosen by the Council
solely on the basis of his/her character and his/her executive and
administrative qualifications with special reference to his/her actual
experience in, or knowledge of, accepted practice in respect to the
duties of his/her office as hereinafter set forth. At the time of
his/her appointment, he/she need not be a resident of the town or
state but may reside outside the Town of Standish while in office
only with the approval of the Council. The Town Manager shall give
bond for the faithful discharge of his/her duties to the Town of Standish
in such sum as the Council shall determine and direct, and with surety
or sureties to be approved by the Council. The premium on his/her
bond shall be paid by the town.
The Town Manager shall be the chief administrative
officer and the head of the administrative branch of the town government
and shall be responsible to the Council for the proper administration
of all affairs of the town. He/she shall have the power and shall
be required to:
A. Appoint and remove statutory officers and department
heads, including but not limited to Code Enforcement Officer, Fire
Chief, Town Clerk and Public Works Director, subject to confirmation
by the Council, and all other administrative officers and town employees,
except as he/she may authorize the head of a department or office
to appoint or remove subordinates in such department or office and
except as otherwise provided by law, by this Charter or by personnel
rules adopted pursuant to this Charter. Statutory officers and department
heads shall have the right to a grievance appeal to the Council.
B. Attend Council meetings, keep the Council advised
monthly of the financial condition of the town, advise the Council
of future needs of the town, make such recommendations as may seem
desirable and have the right to take part in discussions but may not
vote.
C. See that all laws, provisions of this Charter and
policies of the Council are faithfully executed.
D. Assist, insofar as possible, residents and taxpayers
in discovering their lawful remedies in cases involving complaints
of unfair vendor, administrative and governmental practices.
E. Review the Administrative Code annually, submit proposed
changes to the Council for approval and be responsible for its administration.
F. Act as purchasing agent for all departments of the
town and submit to competitive bids any transaction in excess of three
thousand five hundred dollars ($3,500.), except by order of the Council.
G. Prepare and submit the annual budget and capital program
drafts to the Council and Budget Committee and be accountable to Council
for its administration after its adoption.
H. Submit to the Council and Budget Committee and make
available to the public a complete report on the finances and administrative
activities of the town as of the end of each fiscal year.
I. Prepare and submit to the Council such reports and
perform such duties as the Council may require.
J. Make applications for state, federal and other aid
grants for the benefit of the town, as approved by the Council.
To perform his/her duties during his/her temporary
absence or disability, the Manager may, with the advice and consent
of the Council, appoint a qualified administrative officer, not a
Councilor, of the town as Acting Manager. In the event of failure
of the Manager to make such designation, the Council may by resolution
appoint any administrative officer, not a Councilor, of the town to
perform the duties of the Manager until he/she shall return or his/her
disability shall cease. While so acting, he/she shall have the same
powers and duties as those given to and imposed on the Town Manager.
Before entering his/her duties, he/she shall give bond to the town
in a sum and with surety or sureties to be approved by the Council;
the premium on said bond shall be paid by the town. The Manager shall
submit to medical exam at the request of the Council to determine
disability.
