All ordinances of the town and all rules, regulations
and orders legally made by any department, board, commission or officer
of the town, in force on the effective date of this charter and not
inconsistent herewith, shall remain in force until amended, repealed
or superseded as provided herein. All special acts or parts of special
acts relating to the town of West Hartford inconsistent with the provisions
of this charter, except as hereinafter stated, are repealed. The subject
matter contained in Special Act No. 562 of the 1957 General Assembly,
as amended, relating to planning and zoning has not been abrogated,
superseded or otherwise amended by this revision, remains in full
force and effect and has been included herein as a matter of order
and convenience.
The term of office for any appointive member
of any board, commission or similar body in office on the effective
date of this charter shall continue until the expiration of the term
for which said member was appointed, whether or not the method of
appointment to such board, commission or similar body is changed by
this charter. All appointments to such bodies after the effective
date of this charter shall be in accordance with the provisions of
this charter.
The persons holding the elective offices provided
for in Section 2 of Chapter II shall continue in office until their
successors shall have qualified for such offices after being elected
as is provided in Section 2 of Chapter II, except that if a vacancy
shall occur in any of said offices prior to the elections provided
for in said Section 2 of Chapter II, the provisions of this charter
relating to the filling of vacancies in such offices shall apply.
No action or proceeding, civil or criminal,
pending on the effective date of this charter brought by or against
the town or any commission, board, department or office thereof shall
be affected or abated by the adoption of this charter or by anything
herein contained, but all such actions or proceedings may be continued
to conclusion notwithstanding that functions, powers and duties of
any commission, board, department or office party thereto may, by
or under this charter, be assigned or transferred to another commission,
board, department or office, but in that event the same may be prosecuted
or defended by the head of the commission, board, department or office
to which such functions, powers and duties have been assigned or transferred
by or under this charter.
This charter may be amended in the manner prescribed
by law.
If any section or part of any section of this
charter shall be held invalid by a court of competent jurisdiction,
such holding shall not affect the remainder of this charter nor the
context in which said section or part thereof so held invalid may
appear, except to the extent that an entire section or part of a section
may be inseparably connected in meaning and effect with the section
or part of a section to which such holding shall directly apply.
This charter shall become effective on November
5, 1996.
