Within this article, all terms defined in Article III, Recycling, shall have the meaning set forth therein. The following terms shall have the meanings set forth below in this article:
Quarryville Borough, Lancaster County, Pennsylvania.
Large items of solid waste, greater than six feet in any
dimension, including, but not limited to, large automobile parts,
machinery, boats, recreational vehicles, etc.
A portion of municipal waste consisting of materials which
cannot be handled by LCSWMA's normal processing or disposal methods.
Nonprocessable waste includes items greater than six feet in any dimension,
such as mattresses, large furniture and recreational vehicles. Nonprocessable
waste (oversized) may consist of large auto parts, machines, and any
other items deemed appropriate by LCSWMA.
Refuse which will not fit into refuse containers but which
is not nonprocessable refuse, including small furniture, carpet, portable
televisions and the like, but excluding tires and white goods.
A portion of municipal waste consisting of organic waste
materials which, due to biological decomposition, are, or have a tendency
to be, rotten, foul, or odorous, including dead animals and spoiled
foods, but not including sludge.
Refuse is that portion of regulated municipal waste.
A.Â
General regulations for owners and occupants of residential units
and multifamily units.
(1)Â
All regulated municipal waste and recyclable materials shall be stored
so as to prevent the attraction, harborage or breeding of insects
or rodents and to eliminate conditions harmful to public health or
which create safety hazards, odors, unsightliness and public nuisances.
(2)Â
A sufficient number of containers shall be provided by generators to contain all regulated municipal waste and recyclable materials generated during periods between regularly scheduled collection as may be necessary to meet the requirements of Subsection A(1).
(3)Â
Each residential unit shall have a recycling container which may
be provided by the Borough. Recycling containers for multifamily units
shall be provided either by the owner or the permitted collector.
(4)Â
All storage practices shall, at a minimum, conform to the requirements
of all applicable federal, state and local laws and regulations.
(5)Â
Each person having regulated municipal waste or designated recyclable
materials shall provide him/herself with approved refuse and recycling
containers and shall place and keep all regulated municipal waste
and designated recyclable materials therein. Solid waste of a nondecomposable
nature and rubbish may be stored in tightly secured bundles of such
size to be readily handled at time of collection and so as to minimize
litter.
(6)Â
Nonprocessable refuse and oversized refuse items shall be stored
so that collection of water and harborage of rodents are prevented.
(7)Â
Containers shall be stored on the property where the regulated municipal
waste and designated recyclable materials are generated.
(8)Â
Regulated municipal waste or source-separated recyclable materials
from residential units shall not be stored at curbside prior to collection.
(9)Â
No regulated municipal waste or source-separated recyclable materials
shall be placed at curbside for collection more than 24 hours in advance
of the scheduled time for collection. All containers shall be removed
within 24 hours after collection.
B.Â
General regulations for owners and occupants of nonresidential units.
(1)Â
All regulated municipal waste shall be stored so as to prevent the
attraction, harborage or breeding of insects or rodents and to eliminate
conditions harmful to public health or which create safety hazards,
odors, unsightliness and public nuisances.
(2)Â
A sufficient number of containers shall be provided by generators to contain all regulated municipal waste generated during periods between regularly scheduled collection as may be necessary to meet the requirements of Subsection B(1).
(3)Â
All storage practices shall, at a minimum, conform to the requirements
of all applicable federal, state and local laws and regulations.
(4)Â
Each person having regulated municipal waste shall provide him/herself
with approved refuse containers and shall place and keep all regulated
municipal waste therein. Solid waste of a nondecomposable nature and
rubbish may be stored in tightly secured bundles of such size to be
readily handled at time of collection and as to minimize litter.
(5)Â
Nonprocessable refuse and oversized refuse items shall be stored
so that collection of water and harborage of rodents are prevented.
(6)Â
Containers shall be stored on the property where the regulated municipal
waste is generated.
C.Â
Reusable containers for individual residential units. Individual
containers used for the storage of refuse shall have the following
physical characteristics:
(1)Â
The container shall be constructed of durable, watertight, rust-resistant
material having a close-fitting lid.
(2)Â
Individual containers for residential units shall be of a capacity
of not more than 32 gallons or 30 pounds in weight and shall be equipped
with two or more handles and be maintained in a clean and sanitary
manner and be safe to be handled by collection personnel. Notwithstanding
the foregoing, if the collector requires or will accept a wheeled
cart or container of up to 96 gallons, such wheeled cart or container
may be used.
(3)Â
Individual containers shall not be filled so that the lid cannot
fit properly, and the area around the container shall be kept clean.
D.Â
Disposable containers. Disposable refuse containers, such as paper
and polyethylene bags, shall be acceptable for storage of regulated
municipal waste, provided the following conditions are met:
(1)Â
Only those bags specially designed for storage and collection shall
be used.
(2)Â
Bags shall be protected against precipitation, animal damage and
overloading to prevent littering or attracting of vectors.
(3)Â
Bags shall have a holding strength capable of withstanding stresses
until they are collected.
(4)Â
Bag openings shall be securely closed prior to setting out for collection.
E.Â
Recycling containers.
(1)Â
Individual recycling containers utilized for the collection of recyclable
materials at residential units shall comply with the following requirements:

Bulk recycling containers utilized for the storage of recyclable
materials at multifamily and nonresidential units shall comply with
the following requirements:
Occupants of residential units may compost yard wastes which
are generated at said residential unit according to the following
guidelines:
A.Â
Backyard composting shall be done in strict compliance with accepted
standards and guidelines of the Penn State Cooperative Extension Service,
Pennsylvania Department of Environmental Protection, and/or LCSWMA.
B.Â
Composting shall be done within an enclosed structure that controls
access by animals and vectors.
C.Â
Only yard wastes or other vegetative matter may be composted. No
meat or putrescible waste may be composted.
D.Â
Compost shall be turned and mixed on a regular basis to prevent odors,
attraction of vectors and to ensure degradation of materials being
composted.
E.Â
Backyard composters shall be placed no less than one foot from any
property line.
A.Â
All persons occupying residential units and multifamily units within
the Borough are required to source-separate all designated recyclable
materials.
B.Â
All regulated municipal waste and designated recyclable materials
shall be drained free of liquids before storage.
C.Â
All cans, bottles or other food containers shall be rinsed free of
food particles and drained before storage.
Any person violating any provision of this article shall, upon
conviction thereof in a summary proceeding, be sentenced for each
violation to pay a fine of not less than $100 nor more than $1,000
and costs of prosecution, including the Borough's reasonable
attorneys' fees, which fines and penalties may be collected as
provided by law. Each day that a violation continues shall be a separate
offense, and each section of this article which is violated shall
be a separate offense.
