That certain document, a copy of which is on file in the office of the Secretary of the Borough of Trappe, designated National Electrical Code, 1996, published by the National Fire Protection Association, is hereby adopted as the Electrical Code of the Borough of Trappe. The code provides for the safeguarding of persons and property from hazards arising from the use of electricity and deals in detail with regulation of electrical installations, wiring and protection, wiring methods and materials, equipment for general use and special occupancies, special equipment and conditions, and communications systems, and also contains numerous tables and examples. Everything in the National Electrical Code is adopted herein by reference and is made a part of this article just as if it were fully set out in this article, subject to additional provisions as contained in §§ 135-13 through 135-16, as amended.
The said National Electrical Code, as adopted by § 135-12, shall be known as the "Electrical Code of the Borough of Trappe," and may be referred to in this article as "this code."
Notwithstanding anything in Ordinance No. 331
to the contrary, Borough Council shall adopt, from time to time, by
resolution, a fee schedule for permits required to be issued under
this article and regulations adopted thereunder, as well as a fee
schedule, if necessary, to fully recompense the Borough for any administrative
costs in the enforcement of this article and the regulations thereunder.

Notice of violation. Whenever the Code Official observes
an apparent or actual violation of any provision of this code, he
shall prepare a written notice of violation describing the condition
deemed unsafe and specifying time limits for the required repairs
or improvements to be made to render the structure or premises safe
and secure.

Service or notice. The written notice of violation
of this code shall be served upon the owner or occupant or other person
responsible for the condition under violation. That notice of violation
shall be served either by delivering a copy of the same to that person
by ordinary mail to the last known post office address; delivery in
person or by delivering it to and leaving it in the possession of
any person in charge of the premises; or in the case that person is
not found upon the premises, by affixing a copy thereof in a conspicuous
place at the entrance door or avenue of access; and such procedure
shall be deemed the equivalent of personal notice.

Failure to correct violations. If the notice of violation
is not complied with within the time specified by the Code Official,
the Code Official shall request the Borough Solicitor to institute
the appropriate legal proceedings to restrain, correct or abate that
violation or to require removal or termination of the unlawful occupancy
of the structure in violation of any of the provisions of this code
or directions made pursuant thereto. The Police Department of the
Borough shall be requested by the Code Official to make arrests for
any offense against this code or any order of the Code Official affecting
the immediate safety of the public.

Penalty for violation. Any person who violates any
provision of this code or fails to comply with any order issued pursuant
to any section thereof shall be guilty of a summary offense, punishable
by a fine of not more than $300 and costs, and, in default of payment
thereof, to imprisonment for not more than 30 days, provided that
each day on which a violation continues after notice has been served
shall be deemed a separate offense.

Abatement of violation. The imposition of any penalty
herein described shall not prevent the Borough Solicitor from instituting
appropriate action to prevent unlawful construction or to restrain,
correct or abate a violation, or to prevent illegal occupancy of a
structure or premises, or to stop any illegal act, conduct of business
or occupancy of a structure on or about any premises.
Nothing in this article or in the Electrical
Code thereby adopted shall be construed to affect any law suit or
proceeding pending in any court, or rights acquired or liability incurred,
or any cause or causes of action acquired or existing, nor shall any
just or legal right or remedy of any character be lost, impaired or
affected by this article.
