The Village Board finds that the uncontrolled production and depositing of canine waste is unsightly and poses a threat to the public health, safety and welfare to the community, and therefore declares as follows:
It shall be unlawful for any dog owner or person in possession custody or control of any dog to allow such dog to defecate on public property or on private property, other than that of such owner, over the objection of, or without the consent or approval of the owner of such property.
It shall be the duty of each dog owner or person having possession, custody or control of a dog to remove any feces left by such dog on any sidewalk, gutter, street, grassy area between the sidewalk and street, park, school grounds or other public property, and to dispose of the same in a safe and sanitary manner.
A conviction for a violation of this article shall constitute a violation thereof punishable by a fine or civil penalty of not more than $25 for the first offense, $50 for the second violation, and $75 for each subsequent violation.
For the purposes of enforcing the provisions of this article, appearance tickets may be issued by police officers or animal control officers having reasonable cause to believe that a person has violated this article. Additionally, any person observing a violation of this article may file a complaint against the violator with the Village Police Justice, who may summon such alleged violator to appear in person before him.
The provisions of this article shall not apply to a guide dog, hearing dog or service dog accompanying any person with a disability, as defined in New York State Executive Law.
