No development application shall be accepted
by the Borough unless it conforms with the requirements listed in
this article. Plats shall conform with the following requirements
as to form, content, and information shown, and as well comply with
the provision of the Map Filing Law, N.J.S.A. 46-23.1 et seq. All
plats shall be based on a boundary survey drawn by a land surveyor,
as required by law, licensed to practice in the State of New Jersey,
and shall bear the signature, seal, license number, and address of
the land surveyor. All drawings of improvements shall be signed and
sealed by a licensed professional engineer, licensed in the State
of New Jersey.
A sketch plat submitted for purposes of classification
shall contain and/or be supported by the following information:
A.
A map or maps based upon Borough Tax Map information,
or some other similarly accurate base, at a scale preferably not less
than one inch equals 100 feet, so as to enable the entire tract to
be shown on one sheet, on which the information is clearly and legibly
drawn. Information to be shown on the map shall include:
(1)
The location of that portion of the tract which is
to be subdivided in relation to the entire tract;
(2)
All existing structures, uses, and wooded areas within
the portion of the tract to be subdivided and within 200 feet thereof;
(3)
All streets and streams within 500 feet of the tract
to be subdivided;
B.
A brief written statement generally describing the
proposed development and identifying the Tax Map sheet, block, and
lot numbers proposed to be subdivided;
C.
The applicant's name, address, and interest in the
subject property. The owner's name and address, if different from
the applicant.
D.
The names of all adjoining property owners, as disclosed
by the most recent tax records of the Borough.
A.
Requirements for minor subdivision plat or minor site
plan. A minor subdivision preliminary plat or a minor site plan submitted
to the Borough shall be supported by the following information:
(1)
A map or maps based upon Borough Tax Map information,
or some similarly accurate base, at a scale preferably not less than
one inch equals 100 feet for a subdivision plat, and at a scale preferably
not less than one inch equals 50 feet for a site plan. All information
shown on maps should be clearly and legibly drawn. The following information
shall be shown on the map or maps:

(a)
The legal description, including block and lot
designation and street address, if any, of the subject property;
(b)
A description of all existing uses of the subject
property;
(c)
A USGS Quadrangle map, or copy thereof, and
a copy of the municipal Tax Map sheet on which the boundaries of the
subject property and the Pinelands management area designation and
the zoning designation are shown;
(d)
A plat or plan showing the location of all boundaries
of the subject property, the location of all proposed development,
and existing or proposed facilities to provide water for the use and
consumption of occupants of all buildings and sanitary facilities
which will serve the proposed development. The following information
shall be included with respect to existing or proposed sanitary facilities:
[1]
On-site treatment facilities: location, size,
type and capacity of any proposed on-site wastewater treatment facilities;
and
[2]
Soil borings and percolation tests: If on-site sewage disposal is proposed, results of soil borings and percolation tests in accordance with N.J.S.A. 58:11-23 et seq., and the regulations adopted pursuant thereto, shall be submitted at suitable location with a tract map showing location, logs, elevations of all test holes, indicating where groundwater was encountered, estimating the seasonal high water table and demonstrating that such facility is adequate to meet the water quality standards contained in § 285-90 of this chapter.
(e)
A location map, including the area extending
at least 300 feet beyond each boundary of the subject property, showing
ownership boundary lines, the boundary of the proposed development,
owners of holdings adjoining and adjacent to the subject property,
existing facilities, buildings and structures on the site, all proposed
development, wetlands, streams (including intermittent streams), rivers,
lakes and other water bodies and existing roads;
(f)
A soils map, including a county soils survey
which conforms to the guidelines of the United States Department of
Agriculture Soil Conservation Service, showing the location of all
proposed development;
(g)
A map showing existing vegetation, identifying
predominant vegetation types in the area, and showing proposed landscaping
of the subject property, including the location of the tree line before
and after development and all areas to be disturbed as a result of
the proposed development;
(h)
A certificate of filing from the Pinelands Commission
issued pursuant to N.J.A.C. 7:50-4.34 or, until January 14, 1991,
evidence of prior approval from the Pinelands Development Review Board
or the Pinelands Commission pursuant to the Interim Rules and Regulations;
and
(i)
When prior approval for the development has been granted by the Borough, evidence of Pinelands Commission review pursuant to § 285-8B of this chapter.
(j)
The subdivision plat shall show the following:
[1]
Existing and proposed streets and driveways within and adjacent to the tract, with dimensions and proposed easements and any sight triangles necessary, in conformance with § 285-81 of this chapter;
[2]
All proposed lots and all front, side and rear yard setback lines, as required in conformance with Article XIII of this chapter; and
[3]
If the tract lies in more than one zoning district,
all zoning district lines.
(2)
A written statement generally describing the proposed
development and identifying the Tax Map sheet, block, and lot numbers
proposed for development.
(3)
The applicant's name and address, and interest in
the subject property. The owner's name and address, if different from
the applicant.
(4)
The names of all adjoining property owners, as disclosed
in the most recent tax records of the Borough.
B.
Requirements for major subdivision plat and major
site plan. A major subdivision preliminary plat or a major site plan
submitted to the Borough shall be supported by the following information:

(1)
A map or maps based upon Borough Tax Map information,
or some similarly accurate base, at a scale preferably not less than
one inch equals 100 feet for a subdivision plat, and at a scale preferably
not less than one inch equals 50 feet for a site plan. All information
shown on maps should be clearly and legibly drawn. The following information
shall be shown on the map or maps:
(a)
A plat or plan showing the location of all boundaries
of the subject property, the location of all proposed development,
and existing or proposed facilities to provide water for the use and
consumption of occupants of all buildings and sanitary facilities
which will serve the proposed development. The following information
shall be included with respect to existing or proposed wastewater
treatment facilities:
[1]
Sanitary sewer distribution: location, size
and direction of flow of all existing and proposed sanitary sewer
lines and pumping stations serving the proposed development and all
existing and proposed connections to existing facilities;
[2]
On-site treatment facilities: location, size,
type and capacity of any proposed on-site wastewater treatment facilities,
including, except with respect to discharges into an individual residential
septic system, quantities, composition, proposed pretreatment and
ultimate means of disposal;
[3]
Soil borings and percolation tests: If on-site
sewage disposal is proposed, results of soil borings and percolation
tests in accordance with the requirements of N.J.S.A. 58:11-23 et
seq., and the regulations adopted pursuant thereto, shall be submitted
with a tract map showing the location, logs and elevations of all
test holes, indicating where groundwater was encountered, and estimating
the seasonal high water table; and
[4]
The proposed hours and days of operation and
number of employees of any nonresidential facility.
(b)
A project site base map, at a scale of no less
than one inch to 200 feet and including the areas extending at least
300 feet beyond each boundary of the subject property, showing ownership
boundary lines, the boundary of the proposed development, owners of
holdings, if any, adjoining and adjacent to the subject property,
existing facilities, buildings and structures on the site, all proposed
development, wetlands, streams (including intermittent streams), rivers,
lakes and other water bodies, and existing roads;
(c)
A soils map, including a county soils survey
in conformance with the guidelines of the United States Department
of Agriculture Soil Conservation Service, at the same size and scale
as the project site base map, delineating all soil series at an appropriate
level of detail and, in sewered projects, sufficient soil borings
to confirm the accuracy of the soils map;
(d)
A slope map, at the same size and scale as the
project site base map, indicating contour elevations at two-foot intervals;
(e)
A resource capability map, at the same size
and scale as the project site base map, indicating the cumulative
limitations to development due to the standards and the guidelines
contained in this chapter. This map should be prepared prior to any
engineering, site layout or design work;
(f)
A proposed development map, at the same size
and scale as the project site base map, showing areas of proposed
development; the location of surveyor's tape or other markers placed
on the site delineating the boundaries of the property; the number
of residential lots and other type of development in each general
area; all proposed lot lines; areas proposed to be retained as open
space; the applicable land use areas boundaries; the location of proposed
facilities such as dams and impoundments, public or private water
systems, storm drainage systems, public or private sewerage systems,
public utilities, soil erosion and sedimentation control devices,
industrial wastewater discharges and solid waste disposal areas; sources
of air pollution; the proposed primary road network; all areas to
be disturbed by construction activities; existing vegetation, identifying
the predominant vegetation types in the area; and all vegetation which
is to be removed or disturbed as a result of the proposed development,
and the tree line before and after development;
(g)
A map, at the same size and scale as the project
site base map, showing stormwater drainage patterns and calculations
and the applicant's proposed stormwater runoff management plan, which
shall contain results of all percolation tests and soil borings performed
in each recharge area, including the estimated seasonal high water
table;
(h)
Legal instruments evidencing the applicant's
right, title or interest in any Pinelands development credits and
any existing or proposed deed restrictions or easements relating to
the subject parcel;
(i)
A landscaping schedule and plan on a map, of
the same size and scale as the project site base map, identifying
the species of plants to be installed and the quantity and location
of all plants proposed to be planted, demonstrating that the landscaping
will be carried out within six months of the completion of construction
and demonstrating that the landscaping will stabilize soils;
(j)
All public service infrastructure agreements,
or other documentation, evidencing the availability of electric, gas,
water, sewer and other necessary public service infrastructure;
(l)
A list of all permits required for the proposed
development from county, municipal, state and federal agencies;
(m)
A certificate of filing from the Pinelands Commission
issued pursuant to N.J.A.C. 7:50-4.34 or, until January 14, 1991,
evidence of prior approval from the Pinelands Development Review Board
or the Pinelands Commission pursuant to the Interim Rules and Regulations;
and
(n)
When prior approval for the development has been granted by the Borough, evidence of Pinelands Commission review pursuant to § 285-8B.
(o)
The site plan, in addition to meeting the above
requirements, shall show the following, if applicable to the proposal:
(2)
A written description, providing the following information:
(a)
The Tax Map sheet, block, and lot numbers proposed
to be subdivided;
(b)
The applicant's name and address, and interest
in the subject property. The owner's name and address, if different
from the applicant;
(c)
The names of all adjoining property owners,
as disclosed in the most recent tax records of the Borough;
(d)
A general description of the proposed development
and the market it is intended to serve, the number of total dwelling
units, the floor area of all units to be included in the proposed
development;
(e)
A description of existing on-site land uses;
(f)
A description of any soil, slope, and critical
resource data not presented on the base maps;
(g)
A description of public water and sewer systems,
other public utilities, storm drainage plans, erosion and sedimentation
control measures, solid waste disposal methods, and alterations to
shorelines, wetlands, and water bodies;
(h)
A description of any proposed use of pesticides
and herbicides;
(i)
A description of any sources of air and noise
pollution;
(j)
A description of outdoor recreation and open
space resources;
(k)
Legal instruments, such as homeowners' association
charters and agreements, proposed declaration of covenants, deeds,
and other documents and instruments of conveyance;
(l)
All public utility agreements, or other documentation,
evidencing the availability of electric, gas, water, sewer, and other
necessary public utility services;
(m)
A description of any proposed on-site waste
discharges, including, except with respect to discharges into an individual
septic system, quantities, composition proposed pretreatment and proposed
disposal site;
(n)
Legal instruments evidencing the applicant's right, title or interest in any Pinelands development credits, in accordance with the provisions under § 285-108 of this chapter;
(o)
A list of all permits required for the proposed
development from federal, state, county, and local agencies;
(q)
If the proposed development includes industrial
or commercial facilities, a description of:
(r)
A written statement addressing each of the standards or guidelines set forth in Articles XII and XIII; and stating specifically how the proposed development meets each such standard or guideline.

for certain large developments, which immediately followed this subsection.
Requirements for final plat and plan. A major
subdivision plat or major site plan submitted to the Borough for final
approval shall be supported by the following information:
A.
A map or maps based upon Borough Tax Map information, or some similarly accurate base, at a scale preferably not less than one inch equals 100 feet for a subdivision plat, and at a scale preferably not less than one inch equals 50 feet for a site plan. All information shown on maps should be clearly and legibly drawn. The following information, in accordance with the requirements in § 285-43B, should be shown:
(1)
Any data or information requiring changes from the
data and information shown on the preliminary plat or plan, reflecting
the general terms and conditions under which preliminary approval
was granted.
B.
The final plat for final subdivision approval shall
provide the following information and data:
(1)
Name of the subdivision;
(2)
Date of the original drawing and of all revisions;
(3)
Tract boundary lines, all lot lines and other site
lines;
(4)
Right-of-way lines of street, right-of-way widths,
and street names;
(5)
Easements and any other rights-of-way, their dimensions
and purpose;
(6)
Lands reserved or dedicated to public use and their
purpose;
(7)
Accurate dimensions, bearings or deflection angles,
radii, arcs, tangents, central angles of all curves, distance to street
intersections of all tract lines;
(8)
Consecutive numbering from the Tax Assessor of each
new block and lot;
(9)
Minimum building setback line on all lots and other
sites;
(10)
Location and description of all monuments, existing
or to be set in place;
(11)
Name of the owners of any adjoining land;
(12)
Certification of accuracy of plat details by
a licensed land surveyor;
(13)
Certification that the applicant is the owner
or agent of the owner, or that the owner has given consent to subdivide;
and
(14)
Certification of approval by the Borough Engineer.
C.
A final design plan, to be reviewed and approved by
the Borough Engineer prior to the issuance of a building permit or
permits or the construction of any site improvements, consisting of
a map or maps, shall include the following information:
(1)
All information in final form as required for preliminary approval, in conformance with the requirements under § 285-43B, above;
(2)
Proposed elevations shown at building corners and
finished first floor;
(3)
Typical construction details showing cross-sectioned
details of manholes, inlets, pavement, streets, curbs, sidewalk, drainage
channels, headwalls, etc.;
(4)
Typical street cross sections indicating the type
and width of pavement and the location of curbs, sidewalks, typical
underground utilities, and shade tree planting. At intersections,
the sight triangles, radii of curblines, crosswalks, and street sign
locations shall be shown; and
(5)
Final plans, center-line profiles, final grades of
all proposed and existing streets in the tract and within 200 feet
of the subdivision, together with full information as to the disposal
of surface drainage, including final plans and profiles of all on-site
and off-site storm drainage improvements.
