(a)
Required. No person shall construct, alter, add to,
use or operate, or continue to use or operate, any bathing or swimming
place, swimming pool, artificial body of water or other structure
intended to be used for bathing or swimming purposes in which water
may collect in excess of a depth of three feet, without first obtaining
a permit therefor from the Township Code Official.
(b)
Applications. All applications for permits required by Subsection (a) hereof shall be made in writing, shall be submitted in quadruplicate, shall include such drawings or other data as may be required by the Code Official and shall satisfactorily indicate the type of fence and other protective devices as well as the method of construction to be used.
(c)
Validity of Previously Issued Permits. No new permit
shall be required for any swimming pool, place, structure or artificial
body of water if a permit was issued therefor pursuant to Ordinance
76, passed April 20, 1964, and such swimming pool, place, structure
or artificial body of water otherwise meets the requirements of this
chapter.
(d)
Fee. A fee shall be charged for each permit issued
pursuant to this chapter based on the entire value of the proposed
construction, and shall be as specified in Section 208.04(a) of the
Administration Code.

No bathing or swimming place, swimming pool,
artificial body of water or other structure intended to be used for
bathing or swimming purposes in which water may collect in excess
of a depth of three feet shall be constructed, altered, added to or
operated unless the entire perimeter of such swimming pool or place
is surrounded by a fence. The type, quality and method of construction
of such fence shall be approved by the Township Code Official with
the intent that it shall act as a safeguard and protection to children.
Such fence shall be at least four feet, but not more than six feet,
in height, shall be nonremovable, shall have a self-locking type gate
and shall be such as to prevent children or stray animals from going
through or under it.

(a)
Above-ground pools shall comply with the provisions of this chapter, except as may otherwise be provided in subsection (b) hereof.
(b)
The sides of an above-ground pool may be deemed to constitute the fence required by Section 1472.02 if the sides of the pool are of a height of four feet or greater from the ground to the top of the pool. Any above-ground pool in which the sides may be deemed to constitute the required fence must have the access to the pool (e.g. the ladder or steps) protected by either a fence or gate which complies with the requirements of Section 1472.02 or a self-springing safety ladder which automatically rises to at least four feet when not in use.

The location of all pools regulated by this
chapter shall be governed by the Zoning Code. For the purpose of such
Code, all such pools shall be deemed to constitute structures.

(a)
The effective date of this chapter (Ordinance 112,
passed September 21, 1971), as provided by law, is five days after
its adoption.
(b)
All bathing or swimming places, swimming pools, artificial
bodies of water or other structures used for bathing and swimming
purposes, heretofore lawfully constructed or in existence pursuant
to Ordinance 76, passed April 20, 1964, must comply with this chapter
on or before March 1, 1972.
(c)
Pools constructed while both ordinances are in effect
must comply with this chapter.
