There is hereby established the Planning Board of the Village of Coxsackie.
Said Board shall consist of five members and two alternate members who shall be appointed by the Mayor, subject to approval of the Board of Trustees. The Chairperson shall be designated by the Board of Trustees each year at its organizational meeting.
A. 
The initial term of the members of the Planning Board shall be as follows:
(1) 
One for a term of five years.
(2) 
One for a term of four years.
(3) 
One for a term of three years.
(4) 
One for a term of two years.
(5) 
One for a term of one year.
B. 
The initial term of the alternate members of the Planning Board shall be as follows:
(1) 
One for a term of five years.
(2) 
One for a term of four years.
C. 
Upon the expiration of the initial term, each subsequent term shall be for a period of five years.
The Planning Board shall have such powers and duties as are provided by state law or any local law, ordinance or regulation of the Village of Coxsackie. The Planning Board shall have the power and authority to employ experts and a staff, to pay for their services and such other expenses as may be necessary and proper, not exceeding the appropriations that may be made or authorized for such purposes.
An alternate member shall be substituted for a member who is unable to participate because of a conflict of interest on a matter or application before the Board, illness or absence from the Village. The Planning Board Chairperson shall designate the alternate member who is to serve, and when so designated, such alternate member shall possess all powers and responsibilities of such member of the Board. In the event the Planning Board Chairperson is the member for whom substitution should be made, the majority of the Planning Board members present shall designate the alternate member to serve.
Whereas said Planning Board is empowered to approve plats pursuant to § 7-728 of the Village Law, which power is hereby ratified and confirmed, the Clerk of the Village of Coxsackie is directed to file with the Clerk of the County of Greene a certificate showing that the Board of Trustees of the Village of Coxsackie has authorized its Planning Board to approve plats within the Village of Coxsackie pursuant to the provisions of § 7-728 of the Village Law, and the Clerk is requested to write to the County Clerk of the County of Greene and request such clerk, pursuant to § 7-732 of the Village Law, to refuse to file or record in his office any plat of a subdivision until it has been approved by the Planning Board of the Village of Coxsackie.
