No person, firm or corporation shall, without first having obtained the permission of the Board of Trustees therefor, evidenced by a resolution adopted at a meeting thereof and entered in its minutes, erect any booth or stand for the purpose of selling or exposing for sale or advertising any goods, wares or merchandise or erect any platform or grandstand or hang or cause to be hung any banner or advertising device of any kind upon, across or over any public street, avenue or sidewalk or in any public street in the Village of Coxsackie.

Any person, firm or corporation who shall violate any of the provisions of this article shall, upon conviction, be punishable by a fine of not more than $250 or by imprisonment for not more than 15 days, or both.

On application to the Mayor, he may permit an outdoor display and/or sale on sidewalks and adjoining areas, subject to the conditions contained herein.
A permit for an outdoor display and sale shall only be given if the applicant satisfies all of the following criteria:
A. 
The outdoor display and sale shall be restricted to areas zoned for business and shall be in accord with all zoning regulations pertaining thereto.[1]

B. 
The outdoor display and sale shall be a part of a program sponsored by a bona fide commercial or mercantile organization, hereinafter referred to as the "sponsoring organization," which has been actively in existence for at least one continuous year prior to an application hereunder.
C. 
Outdoor displays may only be conducted in front of the premises owned or leased by the displayer or seller.
D. 
The sponsoring organization shall demonstrate that the outdoor display and sale serves the public purpose of furthering the commercial and mercantile growth and stability of the Village at large.
E. 
The permit shall not adversely affect the public welfare.
Any permit issued hereunder shall be for no greater period of time than two consecutive business days, with appropriate provision for alternate days because of inclement weather, with hours of display and sale subject to the approval of the Mayor.
No permit shall be issued to any sponsoring organization more than twice per calendar year.
No person, partnership, organization or any other business entity or subdivision thereof shall participate in more than two sponsored programs per year as a displayer or seller.
The sponsoring organization shall pay a fee of $100 for each permit issued.
This chapter shall be enforced by the Chief of Police or his designee.
Nothing herein shall be construed to prohibit block parties or other special events which are otherwise regulated.
