Discovery requests in matters pending in the
Municipal Court are submitted through the Municipal Prosecutor.
It is necessary to establish the fees that may
be charged for the copies provided, consistent with the provisions
of the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq.
The following fee schedule is hereby established
for all requests for discovery in matters pending in the Borough of
Chesilhurst Municipal Court:
A.
The following fees shall be payable by the requestor
to the Borough of Chesilhurst for the discovery provided:
(1)
Seventy-five cents per page for each of the first
10 pages photocopied.
(2)
Fifty cents per page for each of the next 10 pages
photocopied.
(3)
Twenty-five cents per page for each of the pages photocopied
thereafter.
(4)
Actual postage for any discovery sent by mail.
(5)
Twenty-five cents for the envelope for any discovery
sent by mail.
(6)
Photographs will be photocopied at the rates established
herein. If requests are made for duplicate photographs, the actual
cost of making the photographs shall be charged.
(7)
Duplication of videotapes constitute an extraordinary
duplication process and will be charged at the rate of $5 per videotape.
(8)
If any item cannot be photocopied on the Borough copy
machine or is not otherwise provided for this schedule, the actual
cost incurred in making the copy shall be charged.
B.
Where the discovery must be obtained from an entity
other than the Borough of Chesilhurst, e.g., another police department,
the actual costs paid to the other entity shall be paid by the requestor.
C.

Department discovery fees:

10 pages: $0.50 per page.

pages over 20: $0.25 per page.

Mailed
accident reports: $5.
(5)
Per
disc and disc cover: $4, plus $2 per picture per disc.

Per
picture on CD: $2.
(7)
Digital
print: $0.75 per page.

Per
image on page: $2.
(9)
Each
video or audio tape reproduction: $75.
(10)
Fees
for postage will be determined by weight.
