Upon the installation of a new sewer line or replacement of an old sewer line in any public or private way in the Town of Hadley, Massachusetts, the owner or occupant of any building abutting upon said public or private way must connect the same therewith by a sufficient drain no later than one year after the completion of the construction of said sewer line in front of the building. If said owner or occupant fails to comply with said bylaw, a penalty of $10 a day shall be assessed for said violation.
In the event said owner or occupant had installed a new or replacement septic system which fully complies with Title V, said owner or occupant will not be required to connect to the sewer system for a period of 10 years from the septic system's installation date. Upon the expiration of such ten-year period, or in the event that the property is sold or otherwise transferred (other than to a member of the owner or occupant's immediate family), or upon the failure of said system under Title V, whichever comes first, the owner or occupant will be required to connect to the municipal sewer system.

In the event any person extends a private sewer and then gifts it to the Town, the owners or occupants directly abutting this line will be allowed to voluntarily enter the sewer system. Mandatory connection to the sewer system will be required upon the failure of their existing septic system, as described in Title V requirements, or when the property is sold.

Upon the installation of a new sewer system, residents or owners abutting said system and being assessed a betterment would have a grace period of up to 15 years to voluntarily connect to the sewer system. After 15 years, or in the event of a failure of an existing septic system as described in Title V during this period, or if the property is sold or otherwise transferred, the owners or occupants will be required to connect to the municipal sewer system.

These exemptions are mutually exclusive and therefore are not cumulative.
