The contractor shall:
A. 
Maintain a twenty-four-hour emergency call number for project-connected problems and respond to such emergency requests in a reasonable and timely manner.
B. 
Provide, erect, maintain and remove, upon completion, striping, barricades, signs, lights, cones and other warning and danger signals and devices.
C. 
Store all materials at a place outside the right-of-way of said project area.
D. 
Prior to cutting, opening or altering any roadway, receive approval of the Township Engineer for all projects involving Township roadways.
E. 
Prior to cutting, opening or altering any state roadway, give notification to the Upper Merion Township engineering office at least 48 hours prior to the start of said construction/excavation, together with a copy of the state permit permitting such construction/excavation.
F. 
In the event that traffic is reduced to one lane for both directions or traffic is affected in such a way that normal traffic flow constitutes an increased hazard to traversing motorists or pedestrians on said roadway, provide flagmen at each end of the construction zone for the purpose of traffic direction.
G. 
Perform the following during off-construction hours:
(1) 
Fill all highway openings with suitable material, as approved by the Township Engineer, to preconstruction elevations and maintain a minimum of one lane of travel in each direction.
(2) 
If prior approval is obtained from the Township Engineer, steel plating may be substituted for the temporary backfilling of street openings as described in Subsection G(1) above.
(3) 
Place lighted barricades at each end of the construction zone, together with appropriate signs, as advance warning of an approaching work area where street openings are covered with steel plates.
The contractor shall provide access for police, fire, ambulance, bus and emergency vehicles at all times on all roads in which he is working unless prior approval has been obtained from the Township Engineer and the Chief of Police to deny access for all vehicles into the construction area.
A. 
When the construction of a detour is provided for on the drawings or requested by the jurisdictional authority, the contractor shall furnish and erect all necessary signs, barricades, lights and other warning and danger signals and devices at the contractor's expense.
B. 
If the contractor reroutes traffic over detours, he shall first obtain authorization of the Township Engineer or the appropriate state official having jurisdiction. The contractor shall make all necessary arrangements with such authorities regarding the establishment, maintenance and repair of such detours, the regulation and direction of traffic thereon and signing. Adequate directional and detour signs, acceptable to the appropriate authorities, shall be furnished by the contractor and shall be erected by him at locations where such authorities may direct.
All signs shall be erected and maintained in a suitable manner acceptable to the appropriate authorities and shall be maintained so as to provide maximum visibility and legibility at all times.
The contractor shall provide for prompt removal from existing roadways of all dirt and other materials that have been spilled, washed, tracked or otherwise deposited thereon by his hauling and other operations whenever the accumulation is sufficient to cause the formation of mud, interfere with drainage, damage pavements or create a traffic hazard or dust condition.
The requirements of the agency having jurisdiction over the roadway in which the contractor is working shall govern.
A. 
Noise levels in the construction areas shall be at a level as deemed appropriate by the state and/or Township authorities.
B. 
Construction hours in residential districts.
(1) 
Road construction in residential districts may commence only between the hours of 7:00 a.m. and 9:00 p.m., prevailing time.
(2) 
Exceptions.
(a) 
Work conducted by PADOT or its subcontractors.
(b) 
Work of an emergency nature.
(c) 
Upon written approval of the Board of Supervisors, these times may be modified for specific jobs and specific locations.
C. 
Construction hours on weekends.
(1) 
On Saturdays and Sundays, road construction in residential districts may proceed only between the hours of 0800 and 2100 hours (8:00 am. and 9:00 p.m.), prevailing time.
(2) 
Exceptions.
(a) 
Work conducted by PADOT or its subcontractors.
(b) 
Work of an emergency nature required to safeguard the welfare of the public.
(c) 
Upon written approval of the Board of Supervisors, these times may be modified for specific jobs and specific locations.
Enforcement of this article may be administered by any member of the Police Department or any Code Enforcement Officer.
