As used in this chapter, the following terms
shall have the meanings indicated:
A vehicle for riding upon, usually while standing, propelled
by human power and gravity, consisting of material or a portion of
material formed in a thin firm sheet, usually, but not always, shaped
in an oblong or rectangular fashion, mounted on wheels attached to
the underside.
Operation of a skateboard.
A.
A person engaged in skateboarding shall at all times
operate his or her skateboard in such manner as is reasonable, safe
and prudent under the circumstances and conditions then existing and
so as not to constitute a hazard to any person, property or vehicle.
B.
A person engaged in skateboarding shall use appropriate
safety equipment and attire.
C.
A person engaged in skateboarding shall obey all traffic
and pedestrian control signals as provided by the Pennsylvania Motor
Vehicle Code, 75 Pa.C.S.A. §§ 3112 (relating to traffic
control signals) and 3113 (relating to pedestrian control signals),
or as amended.
D.
A person engaged in skateboarding shall obey the instructions
of a police officer or other person authorized to direct, control
or regulate traffic.
E.
The parent, guardian or other person having legal
custody of any minor shall be responsible for instructing, supervising
and providing safety equipment and attire to such minor who may be
engaged in skateboarding.
A person engaged in skateboarding shall yield
the right-of-way to any pedestrian and shall not overtake or pass
a pedestrian while riding upon or propelling a skateboard. The operator
of the skateboard shall dismount from the skateboard and shall pass
or overtake the pedestrian on foot, or wait until the pedestrian passes,
prior to remounting the skateboard.
No person engaged in skateboarding shall suddenly
leave a curb, sidewalk, berm of street or any other place of safety
and ride upon or propel the skateboard into or toward the path of
a vehicle which is so close as to constitute a hazard. Where there
are no pedalcycle lanes, persons engaged in skateboarding upon a roadway
shall ride as near to the right of the roadway as practical, exercising
due care when passing a standing vehicle or a vehicle proceeding in
the same direction.
No person shall place a ramp, half-pipe or other
structure used for skateboarding in or upon any public thoroughfare,
street, sidewalk or municipal parking lot within the Borough of Danville.
It should be unlawful for any person to engage
in skateboarding in the following areas:
A.
Streets and sidewalks:
(1)
The entire length of Mill Street.
(2)
Ferry Street from East Market Street to Bloom Street.
(3)
The entire length of Continental Boulevard.
(4)
U.S. Route 11 (Northumberland Street, Bloom Street
and Walnut Street) for its entire length through the Borough of Danville.
(5)
Memorial Park, River and Montgomery Parks.

B.
All municipal parking lots in the Borough of Danville.

C.
All private parking lots in the Borough of Danville,
unless permission is granted by the lot owner.
Any person who violates the terms of this chapter
shall be subject to the following penalties:
A.
First offense. The skateboard used in violation of
this chapter shall be impounded by the Police Department of the Borough
of Danville for a period not to exceed 15 days. If the person violating
this chapter is a minor, in addition to the impounding of the skateboard,
the Danville Borough Police Department shall notify the parent, guardian
or other person having legal custody of said minor of the violation
of this chapter and the impounding of the skateboard. In addition,
the person violating the chapter and, in the event that person is
a minor, the parent, guardian or other person having legal custody
of such minor shall be provided with a copy of this chapter by the
Danville Borough Police Department.
B.
Second and/or subsequent offense. The skateboard used
in violation of this chapter shall be impounded by the Danville Borough
Police Department for a period not to exceed 30 days, and said person
shall, upon conviction, be sentenced to pay a fine of $15. If the
person operating the skateboard is a minor, the skateboard shall be
impounded by the Police Department of the Borough of Danville for
a period not exceeding 30 days, and the parent, guardian or other
person having legal custody of said minor shall be responsible for
the violation by the minor and, upon conviction, be sentenced to pay
a fine of $15.
Nothing in this chapter shall be construed to
limit or effect the rights of any private property owner to restrict,
prohibit or permit the use of skateboards on private property.
