There is hereby created and established the office of Municipal Prosecutor. Pursuant to Public Law 1996, Chapter
95, Section 14, the Borough may employ an attorney at law as a prosecutor
under the supervision of the Attorney General or County Prosecutor,
who may represent the state, county or municipality in any matter
within the jurisdiction of the Central Municipal Court or any other
municipal court.
The Borough Prosecutor shall be an attorney at law of the State of New Jersey in good standing. The Municipal Prosecutor shall also have such qualifications as set forth in the job description for Prosecuting Attorney as part of Chapter
42 of this Code.
The Mayor shall nominate and, with the advice and consent of
the Council, appoint a Municipal Prosecutor, including the filling
of a vacancy in such office, which shall be for the unexpired term
only.
The term of office of the Municipal Prosecutor shall be for
one year, commencing on January 1 and terminating on December 31 of
the same year until a successor shall have been appointed and qualified.
The duties of Municipal Prosecutor shall include but not be
limited to prosecution of cases to be tried before the Municipal Court
alleging violations of criminal laws of the State of New Jersey, the
ordinances of the Borough, the motor vehicle statutes of the State
of New Jersey, and such other cases as may be designated by the appropriate
authority as within the jurisdiction of the Municipal Court. The Municipal
Prosecutor shall also appear before the Borough Council upon its request
to prosecute any matter which may be within its jurisdiction.
The compensation to be paid to the Municipal Prosecutor shall
be as the Borough Council shall from time to time provide for in the
annual Salary Ordinance and implementing resolutions.

Pursuant to the authority of N.J.S.A. 2B:25-4, there is hereby
created and established the office of Alternate Municipal Prosecutor.
The qualifications, appointment, term of office and duties of the
Alternate Municipal Prosecutor shall be the same as the Municipal
Prosecutor; provided, however, that the Alternate Municipal Prosecutor
shall serve only in such circumstances where the Municipal Prosecutor
is unavailable.
