The Commissioner of Police, and his/her deputies, shall have the power, in emergency situations, to issue subpoenas and subpoenas duces tecum in the name of the Commissioner directed to any provider of an electronic communication service to compel the production or disclosure of a record or information pertaining to a subscriber to or customer of such service. Such record or information shall not include the content of any communication. An "emergency situation" shall be defined as one:
A. 
Which may result in death or serious injury to any person; and
B. 
Which threatens the imminent commission of a serious offense; or
C. 
Which is of such a nature as to make it possible or impracticable to obtain other judicial process.
