There is created a body corporate and politic to be known as the "Housing Authority of the City."
The Housing Authority of the City shall have and possess all of the authority, powers and duties provided by N.J.S.A. 40A:12A-1 et seq., however, it is not authorized to act as a redevelopment entity.
The Housing Authority of the City shall consist of seven members, of whom five shall be appointed by the Common Council, one by the Mayor and one by the Commissioner of Community Affairs. The members shall serve for terms of five years and until their respective successors have been appointed and qualified. Vacancies shall be filled in the same manner as the original appointments were made, but for the unexpired term. No more than one member of the Housing Authority of the City may be an officer or employee of the City. A certificate of the appointment or reappointment of any member shall be filed with the Clerk of the City.
All expenditures by the Housing Authority of the City, including its debt payments, shall be consistent with its annual budget, which shall be transmitted to the Common Council and Mayor.
Pursuant to N.J.S.A. 55:14A-59, the Executive Director of the Housing Authority of the City shall provide written notice to the Mayor and the members of the Common Council whenever the Housing Authority of the City enters into a written agreement for the planning and construction of a housing development project for which funding assistance shall be sought from state or federal agencies, or both. The Executive Director shall also provide notice to the Mayor and Common Council when the Housing Authority of the City makes application for such assistance. Such notification shall be given within five calendar days of the signing of the written agreement or the application for funding assistance.
