A.
A permanent employee holding a position in the classified service
who is temporarily either mentally or physically incapacitated and
unable to perform his/her duties or who desires to engage in a course
of study which will increase his/her usefulness on his/her return
to the service or who for any other reason considered sufficient by
the Council, with the approval of Council, may be granted special
leave of absence without pay for a period not exceeding six months.
The Council may extend such leave for an additional period of not
exceeding six months.
B.
Any employee asking for special leave without pay shall submit his/her
request, in writing, stating the reasons why, in his/her opinion,
the request should be granted, the date when he/she desires the leave
to begin and the probable date of his/her return to duty.
C.
For each separate case of special leave without pay other than as
herein provided under the statutes the Council, at the time the leave
is approved, shall determine whether the employee granted such leave
shall be entitled to his/her former position on his/her return from
such leave or whether his/her name shall be placed on the reemployment
list for the class.
D.
Except for special leaves granted because of military obligations,
any employee granted a leave of absence by the Council shall have
all fringe benefits discontinued.
A.
Permanent employees.
(1)
Permanent employees of the City shall be entitled to the following
sick leave of absence with pay:

Sick leave may be taken only as earned. If an employee required none
or a portion only of such allocable sick leave for any calendar year,
the amount of such leave not taken shall accumulate to his/her credit
from year to year, and he/she shall be entitled to such accumulated
sick leave with pay if and when needed.
B.
Temporary employees. Temporary employees, pending civil service examination,
shall be entitled to one working day's sick leave with pay for
each month served after they have been classified as permanent employees
of the City.
C.
Department heads. Upon retirement from employment, department heads
shall be compensated for all accumulated sick leave, not to exceed
100 days.
D.
Members of the Police Department. Each member of the Police Department
shall be entitled to sick leave in accordance with the contract between
the City and F.O.P. Lodge 63.
E.
Chief of Police. Compensation to be paid to the Chief of Police for accumulated unused sick time at the time of retirement shall be determined by and in accordance with a contract entered into between the City of Burlington and the particular Chief of Police to which it applies and approved by resolution of the Common Council of the City of Burlington. In the absence of a contract between the City of Burlington and the particular Chief of Police entered into and approved as provided for herein, compensation to such Chief of Police for unused, accumulated sick time upon retirement shall be determined in the same manner as provided for by § 54-20C of this chapter for department heads.

A.
Definition. "Sick leave," for purposes herein, shall mean the absence
from duty of an employee because of personal illness by reason of
which such employee is unable to perform the usual duties of his/her
position, exposure to contagious disease, a short period of emergency
attendance upon a member of his/her immediate family who is seriously
ill and requiring the presence of such employee.

Notification of sick time required. Any employee taking off sick
shall notify his/her department head or the Municipal Clerk by 7:00
a.m., if starting time is 7:00 a.m.; 8:00 a.m., if starting time is
8:00 a.m.; or 9:00 a.m., if starting time is 9:00 a.m. Failure to
comply will result in a written warning for the first offense and
a suspension of three days for the second offense in any twelve-month
period. A continuation of abuse shall result in permanent suspension.
C.
Requirement of medical evidence.
(1)
If an employee is absent for five consecutive working days, for any
of the reasons set forth in the above rule, the appointing authority
shall require acceptable medical evidence on the form prescribed.
The nature of the illness shall be stated on the doctor's certificate
unless it is confidential between doctor and patient.
(2)
At the discretion of the Municipal Clerk or Council, an employee
seeking sick leave may be required to submit acceptable medical evidence.
If the sick leave is not approved, the time involved during which
the employee was absent shall be charged to his/her vacation credit,
if any, otherwise, he/she will suffer loss of pay for such time.
D.
Contagious diseases. Sick leave claimed by reason of quarantine or
exposure to contagious diseases may be approved upon certification
of the local Department of Health.
E.
Computing accumulated sick leave. The total years of service after
permanent appointment of each such employee in the classified civil
service shall be considered in computing accumulated sick leave due
and available.
F.
Disciplinary action. Abuse of sick leave shall be cause for disciplinary
action. Persistent violation will constitute justifiable cause for
dismissal.
G.
Unused sick leave, payment upon retirement.
(1)
CWA employees. Upon retirement from employment, employees subject
to the CWA contract shall be compensated for 1/2 of accumulated sick
leave, not to exceed $6,000.
(2)
Police officers. Upon retirement from the Police Department, a police
officer shall be paid for all accumulated sick leave. For budgetary
purposes, unless the police officer shall have given at least 12 months'
notice of retirement, if the Common Council shall elect, payment may
be paid in equal payments of the year of retirement and the succeeding
calendar year.
In the event of death in the immediate family of an employee,
three days' leave of absence with full pay shall be granted to
make household adjustments or to attend funeral services. "Immediate
family" shall mean wife or husband, mother or father, daughter or
son, sister or brother. Three days shall be counted consecutively
after death in the immediate family. Nonworking days such as Saturday
and Sunday shall be credited as days off in the event of a death in
the family. In the event of death of a father-in-law or mother-in-law
of the employee's household, a one-day leave of absence shall
be granted.
