No incinerators shall henceforth be installed or constructed in any buildings or on any premises in the Township.

Effective July 1, 1969, no person shall operate or use, or permit the operation or use of an existing incinerator without the following equipment: an auxiliary gas burner regulated by automatic firing clocks, an over-fire air fan and nozzle system, and control apparatus, including a wet scrubber, fly ash arrester or such equivalent and additional control apparatus as may be reasonably determined by the Health Officer.

No person shall use or cause to be used any existing incinerator which will emit more than 2/10 grain of particles, including ash, per cubic foot, of dry flue gas at standard conditions corrected to 12% carbon dioxide by volume, excluding the contribution of auxiliary fuel.

No person shall cause, suffer, allow or permit smoke from any incinerator the shade or appearance of which is darker than No. 1 of the Ringelmann Smoke Chart to be emitted into the open air; or emissions of such opacity within a stack or chimney, or exclusive of water vapor, of such opacity leaving a stack or chimney to a degree greater than the emission designated as No. 1 of the Ringelmann Smoke Chart. The provisions shall not apply to smoke emitted during the building of a new fire, the shade or appearance of which is not greater than No. 2 of the Ringelmann Smoke Chart for a period of three consecutive minutes, or emissions of such opacity leaving a stack or chimney to a degree greater than the emission designated as No. 2 of the Ringelmann Smoke Chart for a period greater than three consecutive minutes.

No person shall cause, suffer, allow or permit the emission of particles of unburned waste or ash from an incinerator which are individually large enough to be visible while suspended in the atmosphere.

No person shall construct, install, use or cause to be used any incinerator which will result in odors being detectable by sense of smell in any area of human use or occupancy.

Any person responsible for the use of existing incinerators shall upon request of the Township Health Department provide such sampling facilities and testing facilities, exclusive of instruments and sensing devices, as may be necessary for the Township Health Department to determine the nature and quantity of emissions from such incinerators and shall, during such testing, operate the incinerator at a charging rate of waste no less than the designed capacity of the incinerator using materials representative of the types of waste normally burned. Such facilities may be either permanent or temporary at the discretion of the person responsible for their provisions and shall conform to all applicable laws and regulations concerning safe construction or safe practice.
