[HISTORY: Adopted by the Common Council of the City of Cortland 8-5-1969 as Ch. 13 of

The provisions of this chapter shall be known and may be cited
as "Parks and Recreational Areas."
These provisions are established in order to properly safeguard
to a reasonable degree the life and property of the citizens of the
City and generally to promote the public health, safety and welfare
of the users of the parks and recreational areas contained within
the City.

A.
All parks shall be open from 6:00 a.m. until 10:30 p.m. each day
they are open to the public. No person shall enter or remain in any
park from 10:30 p.m. to 6:00 a.m. Any person violating this provision
shall be subject to the penalties provided for by § 220-30.

B.
In the event a special community event or program is being conducted under the auspices of the Youth Bureau of the City, either alone or in conjunction with a civic or service club, the hours of opening and closing as set forth in Subsection A may be altered to allow for earlier opening and later closing times.

The Youth Bureau when necessary for the public welfare or the
improvement of any park or recreational area and any part thereof
may close any park or recreational area and any part thereof by posting
proper signs at the entrance thereto or at the part to be closed.

A.
No person shall enter or leave any park or recreational area or building
therein contained except by the established entrances and exits.
B.
For purposes of this chapter, "established entrances or exits" shall
be deemed to refer to the natural and normal means of ingress and
egress to each park or recreational area. The natural and normal means
of ingress and egress are those locations accepted by the community
at large and/or maintained by the Youth Bureau.

A.
No person shall sell, send or otherwise dispense food or drink, for consideration of whatever manner it would take, in any park or recreational area without a license as required by Chapter 213, Peddling and Soliciting, §§ 213-1 and 213-6, and written permission from the Youth Bureau, except that fraternal or sororal, service, political and other organizations may obtain such a permit from the Youth Bureau to hold picnics or barbecues for special events.
B.
Application for a permit shall be made in writing to the director
of the Youth Bureau on forms to be supplied, upon request, by said
Commission.

A.
The City's swimming facilities shall be closed when lifeguards are
off duty.
B.
Children under six years of age shall at all times be under the supervision
and control of a parent, guardian or any other person having charge
of caring for any such child at all times at Wickwire Pool and any
wading pool under the jurisdiction of the Youth Bureau.
C.
Children under nine years of age shall at all times be under the
supervision and control of a parent, guardian or any other person
having charge of caring for any such child at all times when any such
child shall be on the beach or in the water at Yaman Park.

All buildings existing on park or recreational area property
shall be used for only those purposes for which such buildings are
designated. A "building," for the purpose of this chapter, shall mean
any structure which stands on park or recreational area property.
Buildings in a park or recreational area recognized and designated
as shelters shall be used only for the purposes of picnicking.

Admission, permit and any other fees which may be charged for
the use of park or recreational area property for certain activities
shall be established from time to time by the Youth Bureau.

No parent, guardian or other person having charge of caring
for any child shall permit them to do any act prohibited by this chapter.
Children under nine years of age shall at all times be under the supervision
and control of a parent, guardian or any other person having charge
of caring for said child.

No person shall handle, injure, destroy or damage or appropriate
to themself trees, shrubs, flowers or other plants growing in any
park or recreational area; or damage, destroy, deface or appropriate
to themself or anybody else any building, fence, bench, table, fireplace,
sign or other property within the limits of any park or recreational
area. In addition thereto, there shall be no unauthorized moving of
any property by any person from the place in the park or recreational
area in which such park or recreational area property is situate.

No person shall sell or offer for sale any article or thing in any park or recreational area and no person shall solicit in any park or recreational area for any purpose whatsoever. The provisions of this section shall not apply to any person or organization holding a permit in any park or recreational area authorized by the Youth and Recreation Commission within the provisions of their written permit obtained pursuant to the provisions of § 202-6B of this chapter.
No person shall post any bill, notice, advertisement or other
written or printed matter within the limits of any park or recreational
area.

No person shall do any act or acts which cause disruptions of
the public peace or which are meant to annoy or alarm another person
present in any park or recreational area. Additionally, any act or
acts which constitute disorderly conduct, harassment or loitering
as defined by the Penal Law of the State of New York or the ordinances
of the City of Cortland are forbidden under this section.
No person shall disrobe, or assist, aid or abet any other person
in disrobing within any park or recreational area, except in designated
places.

A.
No person shall tent, camp, erect or maintain a tent shelter in any park or recreational area except by written permit, said written permit to be obtained pursuant to the provisions of § 202-6B of this chapter.
B.
No person shall tent, camp or erect or maintain a tent shelter in
any park or recreational area during the hours of darkness.
No person shall carry or discharge an air rifle, firearm, sling
shot or bow and arrow, or throw stones or any other missile within
the limits of any park or recreational area.

Any game involving the use of a ball such as a baseball, softball,
basketball, soccer ball or football, but not limited to these examples,
shall be conducted only in those sites of a park or recreational area
specifically authorized and set aside for such purposes.
The playing or practicing of golf, including the driving or
hitting of golf balls, is prohibited in any park or recreational area.

A.
Charcoal shall be the only manner of fuel used by the public for
cooking purposes within any park or recreational area.
B.
The preparing of food by cooking may be accomplished only on fireplace
grills specifically placed for this purpose in any park or recreational
area.
C.
The use of propane or similar fuels is prohibited without prior consent
of the Youth Bureau, and such consent should only be given for special
events at the sole discretion of the Youth Bureau.
Trash, which includes all manner of garbage and refuse of any
form or shape whatsoever, shall be disposed of in a park or recreational
area only in those containers which are appropriately and conspicuously
marked for such purposes. At no time shall there be any burning of
trash by the public using any park or recreational area.
There shall not be brought into any park or recreational area
any glass containers which are used for consumable liquids whether
or not the liquid is poured from the glass container before consumption.
For the purposes of this section, a glass container shall include
milk, soda or beer bottles but shall not be limited to these examples
specifically designated as glass containers.

Dogs can be in park only if on a leash and only after Labor
Day and before Memorial Day. No dogs are allowed in the park between
Memorial Day and Labor Day.

A.
Yaman Park shall be the only park or recreational area in which alcoholic
beverages are permitted. Permission for the bringing in of alcoholic
beverages shall be obtained from the Youth Bureau administrative offices
and shall be in the form of a written permit. The permit may be issued
upon the terms and conditions determined by the Youth Bureau.
A.
Obedience to signs, markings. All motor vehicles operated within
park or recreational area limits shall be operated in accordance with
all traffic signs and road markings erected on or along the park or
recreational area roadways.
B.
Use of established roadways. No motor vehicles are to be operated
on other than established roadways in any park or recreational area.
C.
Standing, parking. Motor vehicles shall stand or be parked only in
park or recreational area locations designated for such purposes.
D.
Speed. No person shall operate a motor vehicle within the limits
of any park or recreational area at a rate of speed greater than 15
miles per hour.
E.
"Motor vehicle" defined. For the purposes of this chapter, a motor
vehicle shall include every vehicle propelled by muscular or any other
means of power, except a wheelchair.
No person shall refuse or neglect to obey any reasonable direction
of any member of the Police Department performing police duties in
the parks.
No person shall refuse or neglect to obey any reasonable direction
of any park attendant, who is performing those duties required in
the operation of any park.
All the provisions of the Vehicle and Traffic Law of the state,
and of the traffic ordinances of the City, and of the fines and punishments
therein provided, and all provisions of the statutes of the state
and other ordinances of the City and the fines and penalties therein
provided, shall apply to any action, violation, offense or crime committed
within any park or recreational area of the City.

A.
The facility is not supervised. Skate at your own risk. Know your
abilities.
(1)
All users must wear a helmet at all times.
(2)
Elbow and knee pads are recommended.
(3)
Smoking, alcoholic beverages, and drugs are prohibited.
(4)
Skateboards, in-line skates, scooters, and BMX bikes only. No motorized
vehicles.
(5)
Use of the facility during inclement weather or when the facility
is wet or slippery is prohibited. The skate park will be closed at
these times.
(6)
No profanity, cursing, abusive language, or roughhousing.
(7)
Additional obstacles or any modifications to existing structures
are prohibited.
(8)
All acts of vandalism will be prosecuted to the fullest extent of
the law.
(9)
No dogs or animals allowed in the skate park except service animals.
(10)
Amplified music is prohibited.
(11)
No food, drink, gum, glass or breakable objects on the skating
surfaces.
(12)
Children under the age of 10 should not be left unsupervised.
(13)
Skate park is open dawn to dusk.
(14)
Skate park is under video surveillance.
(15)
Entering after hours is considered trespassing and may result
in a criminal trespass citation and seizure of equipment.
(16)
The City of Cortland is not responsible for personal property.
(17)
The Cortland Youth Bureau reserves the right to close the skate
facility for events, emergencies, or when conditions necessitate.
(18)
The park is considered closed during inclement weather or unsafe
facility conditions.
(19)
All other park rules and regulations must be followed. Failure
to comply with these rules may result in your privileges being revoked.
B.
Helmets required for persons operating a bicycle.
(1)
No person, one or more years of age and less than 16 years of age,
shall operate a bicycle unless such a person is wearing a helmet meeting
the standards of the American National Standards Institute or the
Snell Memorial Foundation's Standards for Protective Headgear for
Use in Bicycling.
(2)
This section shall be administered and enforced in accordance with
§ 1238 of the Vehicle and Traffic Law of the State of New
York.
C.
Helmets required for persons operating skateboards, scooters and
rollerblades. No person under the age of 16 shall operate a skateboard,
scooter, or rollerblades unless such person is wearing a helmet meeting
the standards of the American National Standards Institute of the
Snell Memorial Foundation's Standards for Protective Headgear for
Use in Skateboarding.
D.
Use for recreational purposes limited. It shall be unlawful to operate
skateboards, scooters and rollerblades on public property in any manner
for the purpose of recreation within the City of Cortland except in
the skateboard park at Yaman Park and other areas specifically designated
by the City of Cortland for recreational purposes.
E.
Enforcement. It shall be the duty of the City of Cortland Police
Department to enforce the provisions of this chapter.
F.
Assumption of risk. The use of the skate park at Yaman Park is considered
a high-risk recreational activity with inherent risk of serious injury
or death. The use of the skate park is an assumption of that risk
by the user. The City of Cortland strongly recommends that proper
protective equipment such as helmets, elbow pads, and knee pads be
used by all users of the skate park, regardless of age.

The use of metal detectors is prohibited in all City parks.
No person shall make any excavation by tool, equipment, or utilize
metal detectors of whatever kind, across or over any City park lands
unless authorized by permit or written easement.
Any person violating any of the provisions of this chapter shall be guilty of a violation of the Code of the City of Cortland, punishable as provided in § 1-22, and each day on which such violation occurs shall be deemed a separate violation, and be punishable as such.
