This Code shall be known as the "Code of the Township of Teaneck, New Jersey," and may be so cited.

In the construction of this Code and of all other ordinances, the following rules shall be observed, unless such construction would be inconsistent with the manifest intent of the Township Council:
COMMITTEE
Whenever in this Code any committee is mentioned by name or title, such committee shall be understood to be the committee of the Township Council designated by such name or title, unless otherwise indicated.
COMPUTATION OF TIME[1]
In computing any period of time, the day of the act or event after which the designated period begins to run shall not be included. The last day of the period so computed shall be included, unless it is a Saturday, Sunday or legal holiday, in which event the period shall run until the end of the next day which is neither a Saturday, Sunday nor a holiday. When a period of time prescribed or allowed is less than seven days, intermediate Saturdays, Sundays and legal holidays shall be excluded in the computation.
COUNCIL'S ADVISORY BOARD
A body established by ordinance consisting of a group of individuals who have been appointed by the Township Council to advise the Township Council on a broad content area for which the Township Council desires periodic, ongoing advice.

COUNCIL, TOWNSHIP COUNCIL
Whenever the words "Council" or "Township Council" are used, they shall be construed to mean the Township Council of the Township of Teaneck.
GENDER[2]
A word importing the masculine gender shall extend and be applied to females and to firms, partnerships and corporations, as well as to males.
MAY
The word "may" is permissive.
MONTH
The word "month" shall mean a calendar month.
NUMBER[3]
A word importing the singular number only may extend and be applied to several persons and things, as well as to one person and thing.
OWNER
The word "owner," applied to a building or land, shall include any part owner, any corporation, joint owner, tenant in common, tenant in partnership, joint tenant or tenant by the entirety, of the whole or of a part of such building or land.
PERSON[4]
The word "person" shall extend and be applied to associations, firms, partnerships and bodies politic and corporate, as well as to individuals.
PRECEDING; FOLLOWING
The words "preceding" and "following" mean next before and next after, respectively.
REGISTERED MAIL
The words "registered mail" include "certified mail."
SHALL
The word "shall" is mandatory.
STATE
The word "state" shall mean "the State of New Jersey."
STREET
Whenever the word "street" is mentioned, it shall be construed to include a public highway, road, avenue, court, lane or alley; and it shall also be construed to include a sidewalk or footpath, unless the contrary is expressed or unless such construction would be inconsistent with the manifest intent of the Township Council.
TASK FORCE
A body established by resolution consisting of a group of individuals selected by the Township Council to review and make recommendations to the Township Council on a specific topic or matter of a limited and temporary nature and is disbanded following the making of such recommendations, unless otherwise extended by resolution.

TOWNSHIP
The word "Township" shall be construed as if the words "of Teaneck" followed it.
TOWNSHIP CLERK, CHIEF OF POLICE or OTHER OFFICERS
The words "Township Clerk," "Chief of Police" or such other named Township officer shall be construed to mean the Township Clerk, Chief of Police or such other Township officer or department, respectively, of the Township of Teaneck, New Jersey.
WRITING or IN WRITING
Shall be construed to include any representation of words, letters or figures, whether by printing or otherwise.

The provisions appearing in this Code, so far as they are in substance the same as those ordinances existing at the time of the effective date of this Code, shall be considered as continuations thereof and not as new enactments.

The catchlines of the several sections of this Code, printed in boldface type, are intended as mere catchwords to indicate the contents of the sections, and shall not be deemed or taken to be titles of such sections, nor as any part of such sections, nor, unless expressly so provided, shall they be so deemed when any of such sections, including the catchlines, are amended or reenacted.

Each section of this Code is hereby declared to be a separate section, and the determination of any section or part thereof to be void shall not affect the validity of any other section or part thereof.

A. 
Except as hereinafter provided, whenever in this Code or in any other ordinance of the Township or in any rule, regulation or order promulgated pursuant to such Code or other ordinance of the Township any act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or whenever in such Code or in such other Township ordinance, rule, regulation or order the doing of any act is required or the failure to do any act is declared to be unlawful or an offense or a misdemeanor, where no specific penalty is provided therefor, the violation of any such provision of this Code or of any other ordinance of the Township or of any rule, regulation or order promulgated pursuant to such Code or other Township ordinance shall be punished by one or more of the following penalties: a fine not exceeding $2,000, or imprisonment for any term not exceeding 90 days, or a period of community service not exceeding 90 days.
B. 
Whenever any provision of the New Jersey Revised Statutes limits the authority of the Township to punish the violation of any particular provision of this Code or other Township ordinance or rule, regulation or order promulgated pursuant thereto to a fine of less amount than that provided in this section or imprisonment for a shorter term than that provided in this section, then the violation of such particular provision of this Code or other Township ordinance, rule, regulation or order shall be punished by the imposition of not more than the maximum fine or imprisonment so authorized or by both such fine or imprisonment.
C. 
Each day any violation of this Code or any other Township ordinance or rule, regulation or order promulgated pursuant thereto shall continue shall constitute a separate offense, unless otherwise provided.
D. 
Whenever any such fine is imposed upon any corporation, such fine and costs and charges incident thereto may be collected in an action of debt or in such other manner as may be provided by law.

Pursuant to N.J.S.A. 40:55D-32 et seq., the Township of Teaneck does hereby establish as the Official Map of the Township of Teaneck a certain map entitled "Official Map, Township of Teaneck, Bergen County, New Jersey, August 15, 1983," prepared by Milton Robbins, P.E., L.S., P.P., of New Jersey, Township Engineer of the Township of Teaneck, Teaneck, New Jersey, and said map is hereby adopted as the Official Map of the Township of Teaneck. This map shall be in the place and stead of all prior Official Maps. Pursuant to N.J.S.A. 40:55D-32 et seq., the Township of Teaneck hereby modifies said map to include the designation of the Christian Cole House (1617 River Road, Block 1201, Lot 19), the Old Burial Ground (662 Pomander Walk, Block 212, Lot 2), the Louis Bourgeois House (114 Bogert Street, Block 4090, Lot 1), the John I. Post House (790 Old Newbridge Road, Block 1001, Lot 4), the George V. Demarest House (12 Degraw Avenue, Block 3216, Lot 11) and the Ende-Sutherland House (720 Roemer Avenue, Block 1103, Lot 3) as historic sites.

Pursuant to N.J.S.A. 40:49-4, the ordinances of the Township of Teaneck of a general and permanent nature adopted by the Township Council of the Township of Teaneck, as revised and codified and consisting of Chapters 1 through 38, together with an Appendix, are hereby approved, adopted, ordained and enacted as the Code of the Township of Teaneck, hereinafter referred to as the "Code." The provisions of the Code, insofar as they are substantively the same as those of the ordinances in force immediately prior to the enactment of the Code by this ordinance, are intended as a continuation of such ordinances and not as new enactments. This ordinance and the Code adopted hereby shall supersede and replace the 1965 Code of the Township of Teaneck, as amended and supplemented.

A. 
Pursuant to N.J.S.A. 40:49-4, a copy of the Code, together with a copy of Schedule A setting forth the changes, amendments or revisions to the Code, has been filed in the office of the Township Clerk and shall remain there for use and examination by the public until final action is taken on this ordinance. Following adoption of this ordinance, such copy shall be certified to by the Clerk of the Township of Teaneck by impressing thereon the Seal of the Township, as provided by law, and such certified copy shall remain on file in the office of the Township Clerk, to be made available to persons desiring to examine the same during all times while said Code is in effect.
B. 
Additions or amendments to the Code, when adopted in such form as to indicate the intent of the Township Council to make them a part thereof, shall be deemed to be incorporated into such Code so that reference to the "Code of the Township of Teaneck" shall be understood and intended to include such additions and amendments.

The Clerk of the Township of Teaneck shall cause notice of the passage of this ordinance to be given in the manner required by law. The notice of passage of this ordinance coupled with filing of the Code in the office of the Township Clerk as provided in § 1-9 shall be deemed, held and considered to be due and legal publication of all provisions of the Code for all purposes.

Each section of this ordinance and of the Code and every part of each section is an independent section or part of a section, and the holding of any section or part thereof to be unconstitutional, void or ineffective for any cause shall not be deemed to affect the validity or constitutionality of any other sections or parts thereof.

A. 
Ordinances or parts of ordinances inconsistent with the provisions contained in the Code adopted by this ordinance are hereby repealed; provided, however, that such repeal shall only be to the extent of such inconsistency, and any valid legislation of the Township of Teaneck which is not in conflict with the provisions of the Code shall be deemed to remain in full force and effect.
B. 
The following ordinances have been excluded from the Code and are specifically repealed:
(1) 
Former Chapter 3, Affirmative Marketing Program, of the 1965 Code, adopted January 18, 2005, by Ord. No. 3854.

The adoption of this Code and the repeal of ordinances provided for in § 1-12 of this ordinance shall not affect the following ordinances, rights and obligations, which are hereby expressly saved from repeal:
A. 
Any ordinance adopted subsequent to February 22, 2022.
B. 
Any right or liability established, accrued or incurred under any legislative provision prior to the effective date of this ordinance or any action or proceeding brought for the enforcement of such right or liability.
C. 
Any offense or act committed or done before the effective date of this ordinance in violation of any legislative provision or any penalty, punishment or forfeiture which may result therefrom.
D. 
Any prosecution, indictment, action, suit or other proceeding pending or any judgment rendered prior to the effective date of this ordinance, brought pursuant to any legislative provision.
E. 
Any franchise, license, right, easement or privilege heretofore granted or conferred.
F. 
Any ordinance providing for the laying out, opening, altering, widening, relocating, straightening, establishing of grade, changing of name, improvement, acceptance or vacation of any right-of-way, easement, street, road, highway, park or other public place or any portion thereof.
G. 
Any ordinance or resolution appropriating money or transferring funds, promising or guaranteeing the payment of money or authorizing the issuance and delivery of any bond or other instruments or evidence of the Township's indebtedness.
H. 
Ordinances authorizing the purchase, sale, lease or transfer of property or any lawful contract, agreement or obligation.
I. 
The levy or imposition of taxes, assessments or charges or the approval of the municipal budget.
J. 
The dedication of property or approval of preliminary or final subdivision plats.
K. 
All currently effective ordinances pertaining to the rate and manner of payment of salaries and compensation of officers and employees.
L. 
Any ordinance adopting or amending the Zoning Map.
M. 
Any ordinance relating to or establishing a pension plan or pension fund for municipal employees.

A. 
In preparing the revision and codification of the Township's ordinances pursuant to N.J.S.A. 40:49-4, certain minor grammatical and nonsubstantive changes were made in one or more of said ordinances. It is the intention of the Township Council that all such changes be adopted as part of the Code as if the ordinances so changed had been formally amended to read as such.
B. 
In addition, various changes, amendments or revisions were made to reflect changes in the law or to eliminate conflicting ordinance provisions and ordinance provisions which are no longer applicable or necessary, to become effective upon the effective date of this ordinance. The changes, amendments or revisions are set forth in Schedule A attached hereto and made a part hereof are made herewith, to become effective upon the effective date of this ordinance. It shall be unlawful for anyone to change, alter or tamper with the Code in any manner which will cause the laws of the Township of Teaneck to be misrepresented thereby. Anyone violating this section shall be subject, upon conviction, to one or more of the following penalties: a fine of not more than $2,000, imprisonment for not more than 90 days or a period of community service not exceeding 90 days, in the discretion of the Judge imposing the same.
