From October 1 of each year to the next succeeding May 1, it
shall be the duty of every person who shall have contracted or undertaken
or shall be bound to heat or to furnish heat for any building or portion
thereof occupied as a home or place of residence to heat or furnish
heat to every unit of dwelling space and every habitable room therein
to be maintained to at least at 68° F. whenever the outside temperature
falls below 55° F. during daytime hours from 6 a.m. to 11 p.m.,
and to maintain a temperature of at least 55° F. at times other
than those specified whenever the outside temperature falls below
40° F.

(a) The custodian of the building shall immediately notify the Teaneck
Health Department and all tenants who may be affected whenever unanticipated
breakdowns cause the following to occur:
(1)
The failure of a heating system when the heat will be below
the prescribed levels for two hours or more.
(2)
The failure of any other utility service, such as gas, electricity
or water.
(b) The notification to the Health Department and tenants shall specify
the nature of the failure, measures being taken to restore heat or
utility service and estimated length of time for restoration.
(c) The building owner shall be responsible for ensuring compliance with
this section.

(a) Whenever a building is heated by means of a furnace, boiler or other
apparatus under the control of the owner, agent or lessee of such
building, such owner, agent or lessee, in the absence of a contract
or agreement to the contrary, shall be deemed to have contracted,
undertaken or bound himself to furnish heat in accordance with the
provisions of this article.
(b) Where a person who is bound to furnish heat, as provided by this
article, is a corporation, such corporation and the president, secretary
and treasurer thereof and also the superintendent and the manager
of the premises shall each be liable for any failure to comply with
the provisions of this article.
