For the purpose of this chapter, the following terms, phrases, words and their derivations shall have the meanings stated herein unless their use in the text of this chapter clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
CONTAINERIZED
Means the placement of yard waste in a trash can, bucket, bag or other vessel, such as to prevent the yard waste from spilling or blowing out into the street and coming into contact with stormwater. Regulations for said containers shall be as established by the Municipal Manager.
PERSON
Any individual, corporation, company, partnership, firm, association or political subdivision of the state subject to municipal jurisdiction.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive or other way which is an existing state, county or municipal roadway, and includes the land between the current street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas and other areas within the street lines.

YARD WASTE
Leaves and grass clippings.

Sweeping, raking, blowing or otherwise placing yard waste that is not containerized at the curb or along the street is only allowed during the seven days prior to a scheduled and announced collection, as determined by the Municipal Manager, and yard waste shall not be placed closer than 10 feet to any storm drain inlet. Placement of such yard waste at the curb or along the street at any other time or in any other manner is a violation of this chapter. If such placement of yard waste occurs, the party responsible for placement of the yard waste must remove the yard waste from the street or said party shall be deemed in violation of this chapter. The frequency of pickups shall be determined at the discretion of the Municipal Manager. Any area which the municipality determines to have no yard waste will be exempt from the collections.

(a) 
It is prohibited and will be deemed a violation hereof for any owner, lessee or occupant of any residential, industrial, commercial or institutional property in the Township to put into or caused to be put into the municipal solid waste collection system any leaves at any time of the year.
(b) 
Leaves are to be put out for municipal collection as designated by the Municipal Manager and are to be collected in the manner prescribed by the Municipal Manager.
(c) 
Sweeping, raking, blowing or otherwise placing leaves that are not containerized at the curb or along the street is only allowed during the seven days prior to a scheduled and announced collection, as determined by the Municipal Manager, and leaves shall not be placed closer than 10 feet to any storm drain inlet. Placement of leaves at the curb or along the street at any other time or in any other manner is a violation of this chapter. If such placement of leaves occurs, the party responsible for placement of the leaves must remove the leaves from the street or said party shall be deemed in violation of this chapter.

The provisions of this chapter shall be enforced by the Township Engineer or his designee.

(a) 
Any person violating the provisions hereof shall receive no more than two warning notices before enforcement action is commenced.
(b) 
Each day shall constitute a separate violation of the provisions hereof.
(c) 
Any person violating the provisions hereof, or any part hereof, shall be subject to a fine or penalty as provided in § 1-6 of the Township Code.
