§ 55-1 Title.

This chapter shall be known and may be cited as the "Games of Chance Law of the Town of Colden."

§ 55-2 Statutory authority.

This chapter is enacted pursuant to the option granted to the municipality by virtue of Article 9-A of the General Municipal Law of the State of New York.

§ 55-3 Definitions.

A. The words and terms used in this chapter shall have the same meaning as such words and terms used in Article 9-A of the General Municipal Law, unless otherwise provided herein or the context requires a different meaning.

B. As used in this chapter, the following terms shall have the meanings indicated:

CLERK

The Town Clerk of the Town of Colden.

OFFICER

The Erie County Sheriff's Department.

TOWN

The Town of Colden.

§ 55-4 Authorization; license.

The Town Board of the Town of Colden hereby provides that it shall be lawful for any authorized organization, upon obtaining a license therefor as provided in Article 9-A of the General Municipal Law, to conduct games of chance within the territorial limits of the Town of Colden, subject to the provisions of this chapter.

§ 55-5 License fee.

The fee payable to the Town Clerk upon issuance of a license shall be in accordance with and as provided by law.

§ 55-6 Sunday games.

The conduct of games of chance on Sundays is authorized, except as otherwise provided in Article 9-A of the General Municipal Law.

§ 55-7 When effective.

This chapter shall take effect immediately if approved by the qualified electors of the Town of Colden at a referendum to be held at the same place of the general election on November 5, 1991.[1]
