[HISTORY: Adopted by the Town Board of the Town of Waterford 9-5-1978 by L.L. No. 4-1978. Amendments noted where applicable.]
The office of Chief of Police of the Police Department of the Town of Waterford shall be and hereby is abolished.

A. 
The office of Public Safety Commissioner shall be a full-time position.
B. 
The head of the office shall be the Public Safety Commissioner, appointed in the manner set forth in § 31-3 hereof.
C. 
In addition to the other Town officers specified in the Town Law, the Town shall have a Public Safety Commissioner.

The Public Safety Commissioner shall be appointed by the Town Board by a vote of not less than four members of the Town Board.

A. 
The term of office of the Public Safety Commissioner shall be five years, with the first term expiring on January 1, 1992, and thereafter expiring on the first day of January every five-year period thereafter.
B. 
The annual compensation of the Public Safety Commissioner shall be fixed by the Town Board in the same manner as the annual compensation of all other officers, appointed officials and department heads is fixed.

The duties of the Public Safety Commissioner shall be as follows:
A. 
To exercise supervision over the Police Department as the administrative and executive head of such Department and to perform all duties and delegate all authority necessary to carry out such functions.
B. 
To appoint and remove personnel from the Police Department, to and from existing positions and from positions as may be from time to time created by the Town Board.
C. 
To oversee the proper maintenance, supervision, instruction, scheduling and attendance of all Police Department personnel.
D. 
To prepare and submit from time to time fiscal reports relative to the operation of the Police Department and to recommend to the Town Board such changes in the methods, practices and procedures involved in the operation of the Department and procurement of equipment necessary or desirable to promote the modernization of the Department, all consistent with its efficient operation.
E. 
To promulgate rules and regulations of the Police Department, subject to the prior approval of the Town Board of any such rules and regulations.
F. 
To perform such other and various duties as the Town Board, from time to time, may designate.
This chapter hereby supersedes § 150 of the Town Law of the State of New York to the extent that such section is inconsistent or in conflict with this chapter.
This chapter shall not take effect unless and until it shall have been submitted to the electors of the Town of Waterford at a general election and shall have received a majority of all votes cast for or against it at such election, and such chapter shall be submitted to the electors of the Town of Waterford at the general elections to be held on November 7, 1978.
