It shall be unlawful to litter the streets, alleys, sidewalks,
public ways or playgrounds of the Town of Waterford.
A.
Garbage and trash shall be placed in containers not to exceed a size
of 30 gallons.
B.
All garbage and trash shall be placed in tightly covered containers.
C.
Containers of garbage and trash, when full, shall not exceed 40 pounds
in weight.
D.
Plastic bags of suitable strength and tightly tied may be used as
containers for garbage and trash.
E.
Hedge clippings, shrub clippings and small twigs must be bundled
and tied or they will not be picked up. Such bundles must not exceed
18 inches in length.
F.
Garbage and trash containers must be kept inside of fence line or
suitable enclosure at all times except from 5:00 p.m. the day before
scheduled pickup.
G.
Containers of garbage and trash shall be placed at curbside or as
close as possible to curbside. Where pickups are made in alleys, containers
of garbage and trash shall be placed to the side of the alley and
not on street side of houses.
H.
Items such as stones, dirt, tires, tree branches, building materials,
remains of demolition, large household appliances and similar items
shall not be placed in garbage and trash containers. Such items are
to be disposed of by the individual owner or tenant.
I.
The term "garbage and trash," as used herein, shall not include properly
segregated recyclables.
The owner of any property within the Town of Waterford, regardless
of whether said owner is an occupant of said property, shall be responsible
for any violations occurring on the property by reason of the conduct
of any tenant of the property.
The following public servants of the Town of Waterford are hereby
authorized to issue and secure appearance tickets in connection with
this article:
A violation of this article shall constitute an offense punishable
by a fine of $100 for the first offense; $200 for the second offense;
and $300 for the third offense and each subsequent offense. Each week
that a violation is allowed to remain shall constitute a separate
offense.
Upon one week's written notice to the property owner, the Town
of Waterford may use its own forces to abate any violation and shall
charge the owner of said property the cost to the Town for said work.
If said charges are not satisfied within 30 days, the Town may place
a lien upon said property which shall be assessed, levied and collected
in the same manner as other Town charges levied on property outside
villages.
