The exterior of all premises shall be kept free of the following matter, materials or conditions:
A. 
Refuse or rubbish as hereinbefore defined.
B. 
Abandoned, uncovered or structurally unsound wells, shafts, towers, exterior cellar openings, basement hatchways, foundations or excavations.
C. 
Abandoned iceboxes, refrigerators, heaters, television sets and other similar major appliances.
D. 
Structurally unsafe or unsound buildings, structures or fences.
E. 
Rodents, vermin, pest infestations or rodent harborages.
F. 
Hidden or uncovered ground or surface hazards, such as holes, sudden depressions, sharp or jagged projections or obstructions.
G. 
Buried rubble, refuse or rubbish.
H. 
Stagnant surface water or groundwater accumulations which create or are likely to create mosquito or other insect breeding areas.
I. 
Nuisances as hereinbefore defined.
J. 
Vehicles or parts thereof, including boats and trailers, motorized or not, licensed or unlicensed, registered or unregistered, which vehicles or parts thereof are or have been junked, abandoned, dismantled or are in a state of visible disrepair.
K. 
Dangerously loose and overhanging objects, including but not limited to dead trees or tree limbs, accumulations of ice or any object, natural or man-made, which would threaten the health and safety of persons if caused to fall, or other similar dangerously loose and overhanging objects which, by reason of their location above ground level, constitute an actual hazard to persons or vehicles in the vicinity thereof.
L. 
Inadequate or unsafe foundation walls, retaining walls, piers and columns and other similar structurally unsound, damaged or defective load-bearing components which are incapable of bearing imposed loads safely at all points.
M. 
Structurally unsound, loose, dangerous, crumbling, missing, broken, rotted or unsafe exterior portions of buildings or structures, including but not limited to porches, landings, balconies, stairways, handrails, steps, sidewalks, walls, overhangs, roofs, fences, retaining walls, supporting members, timbers, abutments, fire escapes and signs, and loose, crumbling or falling bricks, stones, mortar or plaster.
The exterior of all premises shall comply with the following standards:
A. 
All exterior premises shall be maintained in a clean, safe and sanitary condition. The occupant shall keep that part of the exterior premises which such occupant occupies or controls in a clean and sanitary condition.
B. 
All premises shall be graded and maintained to prevent the erosion of soil and to prevent the accumulation of stagnant water thereon or within any structure located thereon.
C. 
The exterior of all premises shall be maintained free from weeds or plant growth in excess of 10 inches (254 millimeters). All noxious weeds shall be prohibited. "Weeds" shall be defined as all grasses, annual plants and vegetation, other than trees or shrubs; provided, however, that this term shall not include cultivated flowers and gardens.
D. 
All structures and the exterior of all premises shall be kept free from rat infestation. Where rats are found, they shall be promptly exterminated by approved processes which will not be injurious to human health. After examination, proper precautions shall be taken to prevent reinfestation.
E. 
Pipes, ducts, conductors, fans or blowers shall not discharge gases, steam, vapor, hot air, grease, smoke odors or other gaseous or particulate wastes directly upon abutting or adjacent public or private property or that of another tenant.
F. 
All accessory structures, including detached garages, fences and walls, shall be maintained structurally sound and in good repair.
The exterior of all structures shall comply with the following standards:
A. 
The exterior of a structure shall be maintained in good repair, structurally sound and sanitary so as not to pose a threat to the public health, safety or welfare.
B. 
All wood and metal surfaces, including but not limited to window frames, doors, doorframes, cornices, porches and trim, shall be maintained in good condition. Peeling, flaking and chipped paint shall be eliminated and surfaces repaired.
C. 
All structural members shall be maintained free from deterioration and shall be capable of safely supporting the imposed dead and live loads.
D. 
All foundation walls shall be maintained plumb and free from open cracks and breaks and shall be kept in such condition so as to prevent the entry of rats.
E. 
All exterior walls shall be free from holes, breaks, loose or rotting materials and maintained weatherproof and properly surface coated where required to prevent deterioration.
F. 
The roof and flashing shall be sound, tight and not have defects that admit rain. Roof drainage shall be adequate to prevent dampness or deterioration in the walls or interior portion of the structure. Roof drains, gutters and downspouts shall be maintained in good repair and free from obstructions. Roof water shall not be discharged in a manner that creates a public nuisance.
G. 
All canopies, marquees, signs, metal awnings, fire escapes, standpipes, exhaust ducts and similar overhang extensions shall be maintained in good repair and be properly anchored so as to be kept in a sound condition. When required, all exposed surfaces of metal or wood shall be protected from the elements and against decay or rust by periodic application of weather-coating materials, such as paint or similar surface treatments.
H. 
Every exterior stairway, deck, porch and balcony, and all appurtenances attached thereto, shall be maintained structurally sound, in good repair, with proper anchorage and capable of supporting the imposed loads.
I. 
All chimneys, cooling towers, smokestacks and similar appurtenances shall be maintained structurally safe and sound and in good repair. All exposed surfaces of metal or wood shall be protected from the elements and against decay or rust by periodic application of weather-coating materials, such as paint or similar surface treatments.
J. 
Every handrail and guard shall be firmly fastened and capable of supporting normally imposed loads and shall be maintained in good condition.
K. 
Every window, door and frame shall be kept in sound condition, good repair and weathertight. All glazing materials shall be maintained free from cracks and holes. Every window, other than a fixed window, shall be easily opened and capable of being held in position by window hardware.
L. 
All exterior doors and hardware shall be maintained in good condition. Locks at all entrances to dwelling units, rooming units and guest rooms shall tightly secure the door.
M. 
Every basement hatchway shall be maintained to prevent the entrance of rats, rain and surface drainage water.
N. 
Every basement window that is operable shall be supplied with ratproof shields, storm windows or other approved protection against the entry of rats, where appropriate.
Without limitation by the foregoing, it shall also be the duty and responsibility of owners, occupants or operators to keep the exterior of all premises structurally sound, in good general repair and sufficiently maintained in accordance with the standards and requirements of §§ 138-12, 138-13 and 138-14, to an extent so as to prevent and avoid conditions that violate the purposes of this chapter, as set forth above.
A. 
General provisions.
(1) 
Scope. The provisions of this section shall govern the minimum conditions for maintenance of open and/or vacant areas. Premises shall comply with the conditions herein prescribed insofar as they are applicable.
(2) 
Responsibility. The owner of the premises shall maintain such structures and premises in compliance with these requirements. A person shall not occupy as owner-occupant or let to another for occupancy or use premises which do not comply with the following requirements of this section.
B. 
Requirements.
(1) 
Sidewalks, driveways and paved areas. All sidewalks, steps, driveways, loading areas, parking spaces and similar paved areas for public use shall be maintained in a proper state of repair and free of all debris, potholes, loose or broken pavement so as not to constitute a danger to public health and safety or building occupants.
(2) 
Vacant structures and land. All vacant structures and premises thereof or vacant land shall be maintained in a clean, safe, secure and sanitary condition so as not to cause a blighting problem or adversely affect the public health or safety.
(3) 
Landscaping. Premises with landscaping and lawns, hedges and bushes shall be kept trimmed and from becoming overgrown and unsightly where exposed to public view and where the same constitutes a blighting factor or creates a fire hazard or a danger to public health and safety.
(4) 
Runoff drains and ditches. All premises shall be maintained so as to provide adequate runoff drains to eliminate any recurrent or excessive accumulation of stormwater, garbage, refuse, weeds or trees.
(5) 
Holes and excavations. All premises shall be maintained so as to eliminate, abate, fill or repair holes, excavations, breaks, projections, obstructions, icy conditions, uncleared snow and excretion of pets and other animals on paths, walks, driveways, parking lots and parking areas and other parts of the premises which are accessible to and used by persons on the premises and which constitute a hazard to public health and safety.
