Parking meter zones are established by the traffic control maps, authorized agents or by temporary regulations in conformity with Chapter 3-107, Temporary Traffic Regulations.

A. 
Parking in any parking meter zone on Sundays and on the observance of the following holidays is specifically excluded from the provisions of this chapter:
(1) 
New Year's Day.
(2) 
Martin Luther King, Jr. Day.
(3) 
Presidents Day.
(4) 
Good Friday.
(5) 
Memorial Day.
(6) 
Independence Day.
(7) 
Labor Day.
(8) 
Columbus Day.
(9) 
Veterans Day.
(10) 
Thanksgiving Day.
(11) 
Friday following Thanksgiving.
(12) 
Christmas Day.
B. 
Such holidays as shall be designated by the collective bargaining agreement between the City and AFSCME District Council 90 shall be added to the list in Subsection A above. The Bureau of Police, Traffic Division, shall provide to the City Clerk on or before December 31 of each year an updated list of all applicable holidays for the next year, which list shall be the controlling authority in the event of future changes and/or additions to the holiday schedule noted herein.

A. 
In all parking meter zones, a parking meter, multispace meter or other technologies may be installed to regulate each parking space. All parking spaces shall be plainly designated by signage, lines or markings on the highway or other parking facilities and may be placed either parallel or diagonal to the curb or by any other methods for designation.
B. 
For the purposes of this chapter, "other technologies" shall mean the process for purchasing parking time through pay-by-phone via the use of technology, including telephone, cellular telephone, telephone automation, text message, mobile application, the Internet, or other indicated payment options that may arise from time to time.
C. 
For the purposes of this chapter, "parking meter" means any device, machine, technology or process responsible for regulating parking by accepting legal currency, credit cards, debit cards, smart cards, tokens or any other approved payment methods to pay for parking.
D. 
This chapter is intended to authorize the use of contactless payment processes, including the use of signage, displayed information, digitally scannable quick response (QR) codes, mobile phone applications or other technology as an alternative to the placement of a physical device to serve as a parking meter.

Parking meters and other technologies shall be conveniently located upon the sidewalk or curb or within other designated areas in general proximity to each designated parking space in such a manner to notify a person paying such parking space by authorized means that the space is legally paid or not. Each parking metered space that is regulated shall indicate by a proper signage, marking or other authorized means the established legal parking time and, when in operation, shall also indicate the duration of the period of legal parking and any illegal or overtime parking.

Every vehicle parked in any parking meter zone shall be entirely within the lines of the designated parking space.

Nothing in this chapter shall be construed to prohibit the City or an authorized agent from providing free parking spaces for loading and unloading, bus stops, taxicab stands, or other matters of a similar nature.

A. 
Any person who causes, allows, or permits any vehicle to be parked overtime or beyond the period of legal parking time established for any parking meter zone shall pay to the City or an authorized agent an overtime parking charge in the amount of $30.
B. 
There shall be a separate overtime parking charge of $30 for each consecutive separate segment of legal parking time, which time shall be the maximum amount of time allowable for parking in a particular metered zone, for any parking zone during which any vehicle is caused, allowed, or permitted to be parked in such parking meter zone. Failure to pay such overtime parking charge within 96 hours after such violation will result in a processing/penalty charge of $20, for a total overtime parking charge of $50.

A. 
Whenever any vehicle is caused, allowed or permitted by any person to be parked in any parking meter zone for a longer time than is permitted, any duly authorized employee of the City, under the direction of the Mayor, Chief of Police or other authorized agent, shall notify such person of the applicable overtime parking charge by placing a written notice or ticket under the windshield wiper, or in some other conspicuous place on such vehicle, indicating:
(1) 
The time of the violation;
(2) 
The amount of the overtime parking charge;
(3) 
That such charge shall be paid to the City or authorized agent within 96 hours from the time of the violation;
(4) 
The place where such charge shall be paid; and
(5) 
The manner of payment.
B. 
All overtime parking charges, including any additional late charges, shall be paid to the City or authorized agent no later than 10 days after the date of the violation, and the notice or ticket placed on the vehicle at the time of the violation shall advise the owner or operator of such vehicle that, unless the overtime parking charge, including any additional late charge, is paid within the time limits herein specified, the fine payable upon conviction of overtime parking and failure to pay such charges within the time set forth above will be $50 and costs and, in default of payment thereof, imprisonment for not more than 10 days.

In any proceeding for a violation of the provisions of this chapter, the registration plate displayed on such vehicle shall be prima facie evidence that the owner of such vehicle was then operating the same. If at any hearing or proceeding the owner shall testify under oath or affirmation that he or she was not operating such vehicle at the time of the alleged violation of this chapter and shall submit to an examination as to who at that time was operating such vehicle, and reveal the name of the person, if known, then the prima facie presumptive evidence arising from the registration plate shall be overcome and removed and the burden of proof shifted.

In the area of the City bounded by Front Street on the west, Chestnut Street on the south, Fisher Plaza on the east and Forster Street on the north, rates shall be $3 per hour of parking. In all other areas within the City of Harrisburg, the parking meter rates shall be $1.50 per hour of parking. The bagged parking meter rate shall not exceed the highest hourly meter rate multiplied by the hours the meter is in operation for each day.

Upon entering a designated space in a parking meter zone, the operator thereof shall immediately comply with the parking regulations that are in effect and pay the applicable fees by any of the means accepted, which may be legal tender of the United States, credit cards, debit cards, smart cards or any other authorized means that are accepted to pay for parking at that specific space. Upon the accepted payment of the parking space, such parking space may be lawfully occupied by any vehicle during the permitted period of parking indicated by the parking meter or other technology.

The payments required to be deposited in parking meters are hereby levied and assessed as fees to provide for the proper regulation and control of traffic upon the highways, including the cost of supervising and regulating the parking of vehicles in the parking meter zones created hereby, and the cost of the purchase, supervision, protection, inspection, operation, maintenance, control and use of the aforesaid parking meters.
No owner or operator of any vehicle shall cause, allow, permit, or suffer such vehicle to be parked overtime or beyond the period of the legal parking time established for any parking meter zone.

No person shall pay or cause to be paid any additional parking fees for any space regulated by a parking meter or other technologies for the purpose of increasing or extending the parking time of any vehicle beyond the legal parking time established for any parking meter zone unless authorized by that particular space.
No person shall deposit or cause to be deposited in any parking meter any slug, device or metallic substitute for the required legal coin of the United States.

No person shall deface, injure, tamper with, open, remove or willfully break, destroy or impair the usefulness any parking meter equipment, signage or displayed information.

A. 
No prosecution of any violation of any of the provisions of this chapter may be instituted unless commenced by the filing of a complaint within six months after the date of such alleged violation.
B. 
Whenever a vehicle is caused, allowed or permitted to be parked in a handicapped parking meter zone and said vehicle is not, by law or ordinance, permitted to park in said handicapped parking meter zone, said person shall pay to the City or authorized agent a parking charge equal to $50. If said parking charge is not paid to the City or authorized agent within 96 hours, an additional late charge of $20 shall be added.
C. 
Except as otherwise provided herein, any person who violates the provisions of this chapter shall be subject to the general code penalty, § 1-301.99 of these Codified Ordinances.
