A. 
The Mount Morris Village Board of Trustees finds it necessary to create the following local law due to the increasing numbers of persons under the age of 18, as demonstrated by the service call and report log of the Mount Morris Police Department, finding themselves in situations that put them at risk of harm or interfering with the public peace, especially during the hours of 10:00 p.m. to 5:00 a.m. Sunday through Thursday, and 11:30 p.m. to 5:00 a.m. Friday and Saturday.
B. 
The purpose of this chapter is to better provide security to those persons who are at risk specifically, those persons who are under 18 years of age being out and about unsupervised during the hours of 10:00 p.m. to 5:00 a.m. Sunday through Thursday and 11:30 p.m. to 5:00 a.m. Friday and Saturday pose a threat to themselves and/or the residents of the Village of Mount Morris. This chapter is created to address the concerns regarding the security and peace of all residents and their property. The sanctity of the peace of the Village of Mount Morris is considered paramount.
As used in this chapter, the following terms shall have the meanings indicated, unless a different meaning clearly appears in the context:
ADULT
Any person 18 years of age or older.
PARENT
Any person having legal custody of a person under the age of 18 as a natural or adoptive parent, as a legal guardian, as a person who stands in loco parentis or as a person to whom legal custody has been given by court order.
PUBLIC PLACE
Any place to which the public has access, including any street, sidewalk, or parking lot, thoroughfare, bridge, alleyway, plaza, park, recreation or shopping area, store, cafe, restaurant, public transportation facilities, vehicles used for public transportation, or any other public building, structure, or area, whether privately or publicly owned.
It shall be unlawful and a violation of this chapter for a person under the age of 18 to be, loiter or remain in, on or upon a public place within the Village of Mount Morris between the following hours:
A. 
Beginning at 10:00 p.m. and extending until 5:00 p.m. Sunday through Thursday.
B. 
Beginning at 11:30 p.m. and extending until 5:00 a.m. Friday and Saturday.
A. 
The parent will be held accountable for the actions of any person under the age of 18 in his or her care.
B. 
It shall be the responsibility of the parent to be knowledgeable of the whereabouts of the person or persons under the age of 18 in his or her care during the curfew hours.
C. 
It shall be unlawful and a violation of this chapter for a parent to knowingly permit, or by inefficient control to allow, a person under the age of 18 in his or her care to be or loiter or remain in or on or upon a public place in the Village during the hours defined in § 78-3 of this chapter.
A. 
Any adult who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $250 and/or imprisonment for a term not to exceed 15 days, or community service, or any combination thereof.
B. 
Any persons who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $50 for the first conviction, $100 for the second conviction, and $250 thereafter, or by imprisonment for a term not to exceed 15 days, or community service, or any combination thereof.
C. 
Any parent who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $250 and/or imprisonment for a term not to exceed 15 days, or community service, or any combination thereof.
D. 
Any parent whose minor child is convicted for violation of any provision of this chapter may be guilty of a violation of this chapter punishable by a fine of not more than $50 for the first conviction, $100 for the second conviction and $250 thereafter, or by a term of imprisonment not to exceed 15 days, or community service, or any combination thereof.
A. 
Any person under the age of 18 accompanied by a parent, relative, or other person 21 years of age or cover who is responsible for the care and custody of such person.
B. 
Any person under the age of 18 on the way to, attending or returning home from a cultural, religious, scholastic, athletic, or recreational activity supervised by a bona fide organization.
C. 
Any person under the age of 18 who is engaged in gainful, lawful employment during the curfew hours.
D. 
Any person under the age of 18 who is engaged in travel into, out of, or passing through the Village.
