It is hereby declared the policy of the Village of Greenwood Lake, County of Orange, State of New York, to preserve and maintain the clean and wholesome character of its environs and to preserve and maintain the health and welfare of its residents within the incorporated area of the Village, and in so doing it is necessary to establish regulations governing the accumulation, storage and disposal of garbage, refuse, rubbish, litter and other waste materials within the Incorporated Village of Greenwood Lake.
As used in this article, the following terms shall have the meanings indicated:
AUTOMOBILE
Any passenger car, truck, bus, trailer, motorcycle, Jeep, tractor, bulldozer or the like.
COMMERCIAL USER
Any user other than residential and any residential structure which shall house more than two-family occupancies.
GARBAGE
Putrescible animal or vegetable wastes resulting from selling, handling, preparation, cooking, consumption or partial consumption of food.
LITTER
Nonputrescible solid wastes consisting of both combustible or noncombustible wastes, such as but not limited to paper wrappings, cardboard, empty containers, tin or aluminum cans, wood, glass or glass bottles, ashes or other debris of a nondescript nature.
MUNICIPAL EMPLOYEE
Any employee of the Village of Greenwood Lake, whether on a permanent or temporary basis.
PARK
Any reservation, playground, beach, recreation center, lakefront, vacant land or any other public area owned or operated by the Village and devoted to active or passive recreation.
PERSON
Any individual, firm, partnership, corporation, association or organization of any kind.
PRIVATE PROPERTY/PREMISES
Any vacant land or house, building or other structure not owned or operated by the Village of Greenwood Lake, whether inhabited or temporarily or continuously uninhabited or vacant, including any yard, ground, parking lot, walk, driveway or accessory structure belonging to or appurtenant to such house, building or other structure.
PUBLIC PLACE
Any highway, road, street, avenue, alley, park, public parking area, public driveway, sidewalk, right-of-way, grounds or building or any property under the ownership or control of the Village of Greenwood Lake, or any property open to and/or serving the general public.
RUBBISH
Litter, as defined herein, in quantities necessitating bagging or packaging, any junked, inoperable or abandoned automobile, bicycle, boat or any boat parts, and/or parts or tires of any automobile, bicycle, airplane or helicopter, or any construction or demolition materials, any docks or flotation products, any appliances, furniture, scrap materials or all other waste materials which, if thrown, accumulated or deposited as herein prohibited, tend to create a danger to public health, safety or welfare, or tend to cause pollution of waterways or tend to create an unsightly condition or blight.
A. 
All persons owning or occupying a single-family residential property within the Village of Greenwood Lake shall be required to keep on the premises sufficient, proper and separate metal or rigid plastic receptacles of a minimum capacity of 20 gallons and a maximum capacity of 35 gallons for the deposit of garbage, litter and any other waste materials, with each receptacle to be equipped with a tight-fitting cover and which receptacle shall be kept in a sanitary condition.
B. 
Biodegradable paper bags must be used for the disposal of leaves and grass clippings.

C. 
Dry brush and dry paper shall be bundled and tied for removal on days as specified by the Village Board.
D. 
All persons owning or occupying commercial or nonprofit premises shall be required to keep on the premises sufficient steel rear-load containers of a minimum one-yard capacity with tight-fitting hinged covers, rubber wheels and steel lift bars 1 1/4 inches and of such other specifications as are required by the Village of Greenwood Lake to utilize with automatic lifting equipment of sanitation vehicles licensed as hereinafter provided. Such receptacles shall be maintained in a sanitary condition. The provisions of this subsection shall not apply to owners or occupants of the heretofore-stated premises whose maximum deposit of garbage, refuse and rubbish does not exceed the capacity of four thirty-five-gallon metal or rigid plastic containers on any regular garbage collection day.
E. 
Location of containers.

(1) 
All covered metal and rigid plastic containers, plastic bags, bundled paper and brush shall be placed in front of said premises, at the lot line thereof, on the regular garbage removal days, or days as specified by the Village Board, for the removal therefrom by the Village Sanitation Department. Rear load containers shall be placed in locations on said premises that shall be readily accessible for removal by the Village sanitation vehicles.
(2) 
All metal and rigid plastic receptacles and rear load containers shall, within 24 hours of emptying by the Village Sanitation Department, be returned to storage within the premises or behind the front line of any residence located on the premises, or at the rear or side of said premises, if screened from public view.
F. 
No containers other than those described in this article shall be considered as sufficient or proper for the deposit of garbage, refuse or waste materials.
G. 
These provisions shall not apply during specially announced Village cleanup weeks for the disposal of rubbish that is not acceptable during regular sanitation pickup days.
A. 
No person owning vacant land or owning or occupying any premises within the Village shall permit the accumulation of rubbish, garbage, litter, debris or other waste materials in or surrounding said premises or on said vacant land in such a manner as to create a hazard to the health, safety or welfare of the residents of the Village or to create an unsightly or blight condition.
B. 
No person shall dispose of or deposit garbage, rubbish, refuse, debris or other waste materials in any manner other than as set forth in the preceding sections of this article or as prescribed during specially announced Village cleanup weeks, nor shall any person discard or dispose of garbage, rubbish or any waste material in any public receptacle or any private receptacle not owned by such person in such a manner as to avoid or evade the provisions of this article.
A. 
No person shall deposit, sweep, throw or cast or direct, suffer or permit any agent, servant, employee or any other person under his control to deposit, sweep, throw or cast any litter, garbage, rubbish or waste material of any kind whatsoever in or upon any public place or private property.
B. 
No person shall deposit, throw or cast any litter, garbage, rubbish or waste material in any lake, pond, stream or other body of water within the Village of Greenwood Lake.
C. 
Every owner of any vacant land and every owner, lessee, tenant or person in charge of any building or premises shall keep and cause to be kept said vacant land and the sidewalk and all area abutting said land and said building or premises free from nuisance of any and every kind and shall keep said area free of all loose garbage, refuse, rubbish, litter and other offensive material. Said sidewalk shall be kept free from obstruction.
D. 
No one, being the owner, driver, person in control or passenger of any vehicle, shall throw or cause to be thrown from said vehicle, while moving or standing still, any litter, rubbish, garbage or refuse of any kind whatsoever in or upon any street or public place or upon any vacant lot or private property.
A. 
License required. No person shall engage in the business of receiving, collecting, transporting or disposing of garbage, rubbish, trash or other wastes for hire within the Village of Greenwood Lake without first obtaining a license to do so from the Village Clerk and paying the fee of $25 per year for such license.
B. 
Application for license. Applications for licenses shall be upon forms supplied by the Village Clerk. At the time of making such application, the applicant must furnish to the Village Clerk a schedule of intended pickup days on the various streets within the Village, a schedule of rates and charges for residential customers and a list of vehicles to be used by the applicant. Upon approval by three members of the Village Board, the Village Clerk shall issue said license.
C. 
Bond. A bond in the sum of $1,000 shall be executed by every person or corporation engaging in the refuse collection business within the Village of Greenwood Lake and shall be filed with the Village Clerk before such license shall be issued. Such bond shall be conditioned that said licensee will comply with the laws, codes, ordinances and regulations of the State of New York, the Village of Greenwood Lake and all lawfully issued orders of the Village Board, and that the Village of Greenwood Lake will be indemnified and saved harmless from any and all claims for damages or liabilities caused by or arising out of the failure of the licensee, his agents or employees to comply with applicable statutes, local laws, rules, regulations or orders. Said bond shall be in such form and contain such sureties as shall be approved by the Village Board or its designated representatives.
D. 
Licensing conditions. Every license issued by the Village Clerk pursuant to this section shall be subject to the following conditions and to such other reasonable conditions as may be imposed by the Village Board, and the Board may from time to time adopt regulations implementing such requirements.
(1) 
All vehicles used by licensed refuse collectors shall be cleaned and emptied within 24 hours of the end of each business day.
(2) 
Vehicles used by licensed refuse collectors in the collection and transportation of garbage or rubbish or any other kind of waste within the Village of Greenwood Lake shall be watertight packer or container trucks as approved by the Village Board.
(3) 
The vehicles used by collectors and the routes of collection shall be subject to inspection and reasonable visitation by an authorized inspector or his agent.
(4) 
All licenses issued hereunder shall be valid for a period of one year, expiring on June 1 of the calendar year after the date of issuance. Each licensee shall pay such annual license fee, due on June 1 of each year, as may be determined by the Village Board.
(5) 
Violations of any of the foregoing regulations or of any other provisions of this article shall be cause for revocation of the license of any person holding a license hereunder. The Village Board shall have the power to revoke any such license for cause shown, after hearing upon five days' written notice, specifying the alleged violation to the license holder, by certified mail directed to his principal office at the address filed with the Village Clerk with the licensee's application.
(6) 
All trucks must have a minimum liability insurance for personal injury of $100,000 per person and $500,000 per accident, and for property damage $50,000.
(7) 
No collector shall cease or discontinue business in the Village of Greenwood Lake unless 90 days' written notice has been given to the Village Clerk. This subsection shall not be construed to include the sale or lease of such garbage collection business, a collection route or any part thereof; provided, however, that in the event of such sale or lease, the transferor shall notify the Village Clerk 60 days prior to such transfer, and the transferee shall make application and file a bond as herein provided 30 days prior to such transfer.
E. 
Refusal of license; appeals. A license may be refused if the applicant shall have been convicted of a felony or if the applicant shall fail to meet and/or demonstrate the ability to meet the requirements of this article. Any applicant who has been refused a license may appeal to the Village Board from such refusal, and such license may be granted or refused by such Board, after hearing on said appeal.
A violation of this article shall subject the violator to a fine of not more than $250 or by imprisonment of not less than one day nor more than 15 days, or by a combination of fine and imprisonment. The continuation of an offense against the provisions of this article shall constitute for each day the offense is continued a separate and distinct offense hereunder.
