A.
A Citizen Participation Plan shall be a part of the Community Development
Block Grant ("CDBG") Program of the Department of Building and Housing
Development ("DBHD").

A.
The use of CDBG funds is hereby restricted to projects which benefit
low- and moderate-income persons and families, as defined by the United
States Department of Housing and Urban Development and developed in
accordance with Section 3(b)(2) of the United States Housing Act of
1937.
B.
The limits for families larger than eight persons shall be determined
by using an adjustment of 6.25 percentage points more for each person
beyond the four-person base for moderate-income families and eight
percentage points more for each person beyond the four-person base
for low-income families.
C.
If CDBG funds are used for a portion of the financing for a project,
these restrictions shall be applied on a pro rata basis.

A.
Grantee performance reports on activities benefiting low- and moderate-income
("low/mod") persons shall meet the criteria in 570.208(a)(1), (2),
(3) or (4) of the CDBG regulations.
B.
A "beneficiary" is a social, public service or community organization
recipient, an employee in a newly created job, an employee in a job
retained through the use of CDBG funds, a purchaser, recipient or
owner-occupant of real property or occupant of rental housing or resident
of the area that receives public improvements.
C.
For low/moderate job creation/retention activities, the following
information shall be compiled in a report: the business owner's name;
the name of the business; the location of the business; the loan amount;
the loan purpose; the loan closing date; the expected number of retained
jobs; the expected number of created jobs; and the expected number
of jobs to be held by or made available to low/mod income persons.
For each business assisted, the report shall include the number of
jobs created or retained to date until the job creation goal is met.
D.
For activities addressing slums or blight on an area basis, the report
shall include an activity description; the boundaries of the designated
area; the percentage of buildings deteriorated when the area was designated;
the year of designation; and accomplishments/status of the activity
during the reporting period.
E.
For public service and other nonhousing direct benefit activities,
the report shall include an activity description; the administering
agency; accomplishments/status during the reporting period; the number
of persons assisted; the number of low/mod persons assisted; the racial/ethnic
breakdown of beneficiaries; and the number of female-headed households.
F.
For acquisition activities, the report shall include the address
of the property acquired; the number of units in the structure; the
acquisition date; the acquisition cost; and the target program. For
properties sold "as is," the report shall include the date sold; sale
price; buyer name; and beneficiary information for the occupants of
the structure.
G.
For disposition activities, the report shall include the address
of the property sold; the home buyer name; the date sold; the sale
price; and the beneficiary information for the home buyer (income
level, household size, racial/ethnic status, female-headed household).

Programs which can be funded by CDBG funds include any activities
which comply with the intent of this chapter and which are eligible
CDBG activities, in accordance with 570.201 to 570.206 of the CDBG
regulations.

DBHD shall submit regular quarterly performance reports to Council
within 30 days of the end of each reporting period. Quarterly reports
will correspond with the annual grantee performance report. Time periods
for quarterly reports will include the ninety-day period from August
through October, November through January, February through April,
and May through July. Quarterly reports will include the same level
of information required by the United States Department of Housing
and Urban Development in the annual grantee performance report activity
summary form and direct benefit activities form. Quarterly reports
shall contain the following information:

For low/mod housing rehabilitation activities, include an activity
description, accomplishments/status of the activity during the ninety-day
period, address of the rehabilitated property, the CDBG grant or loan
amount, amount of private funds invested, startup and completion dates,
CDBG funding year(s) and beneficiary information for the occupants
of the rehabilitated housing, including income level, racial/ethnic
status, family size and whether or not it is a female-headed household.
The following information shall be reported for multifamily rehabilitation
projects: total project costs and CDBG share of cost, total number
of units, the number of units to be occupied by low/mod households,
and the census tract and block group in which the project is located.
B.
For low/mod area benefit activities, an activity description, the
census tracts and/or block groups in the service area, the percentage
of low/mod persons in the entire area served, and accomplishments/status
of the project during the reporting period.
C.
The DBHD shall submit to Council information on minority/female participation
and subcontracting of work performed by DBHD. This report will be
the semiannual contract and subcontract activity report (form HUD-2516).
The report covers the period from April through September and from
October through March. DBHD shall submit copies of the report to Council
at the time the report is submitted to HUD.
D.
A description of the progress made on each CDBG-funded project not already described under §§ 8-703.4 and 8-703.6 during the ninety-day period, including a description of the amount of service or assistance provided, the location of area where the service or assistance was provided, the total number of beneficiaries receiving the service or assistance, and a description of the accomplishments of the project.
E.
The total amount of CDBG Program funds expended for each project
and activity during the ninety-day period, including the amount expended
for administration.
F.
The DBHD shall prepare and submit to Council, at the same time the
first quarterly report is due pursuant to this section, a report on
the total amount of unspent CDBG Program funds for CD years to date:
(1)
The amount of unspent funds which are not allocated to a specific
program;
(2)
The specific programs and the specific geographic area by "NSA,"
"NIA," census tract or other geographic designation to which all unspent
funds are allocated, and the CD year they were allocated, the total
amount of unspent obligation CDBG funds from CD years I through XII
and each year thereafter, including the specific programs and the
specific geographic area by NSA, NIA, census tracts or other geographic
designation, to which unspent obligated funds are allocated, and the
CD year they were allocated and the amount of unspent obligated funds
which are not allocated to a specific program.
G.
After the submission of the report required under Subsection F above, DBHD shall submit quarterly expenditure reports to Council covering the same period of time and the same schedule as reported in this section, showing the progress in spending and obligating the unspent funds.
H.
At the same time the quarterly performance reports required pursuant
to this section are submitted to Council, an additional report on
minority/female participation in the contracting and subcontracting
of work performed by DBHD shall also be submitted. The report shall
include the number of contracts with each contractor, the number and
percentage of minority and female employees for each contractor, the
number of contracts with minority and/or female-owned businesses,
the number of contracts with contractors located in the City, and
the number and percentage of employees of each contractor or subcontractor
who reside in the geographic designation where the work is to be performed.
A.
The Mayor's Office of Equal Economic Opportunity (MOEEO) shall provide
quarterly reports to DBHD for economic development projects funded
under the CDBG Business Revolving Loan Program.

B.
Reports shall include all information required of this chapter. DBHD
shall provide this information to Council in its quarterly reports.

C.
To insure the privacy of employees hired through the use of CDBG
Program funds, all recipient records required by this chapter shall
be made available to DBHD personnel only for the purpose of verification
and inspection of recipient records.
The limitations on uses of CDBG funds listed in this chapter
shall not apply to demolition activities conducted by the City.

Since all recipients of CDBG funds fall under the City Affirmative
Action Agreement, every effort must be made to insure that the policies
and objectives of that accord are reached.
