This chapter shall be known and may be cited as the "Refuse
Law of the Village of Roslyn, New York."
As used in this chapter, unless the context or subject matter
otherwise requires, the following words shall have the following meanings:
The properties, buildings and occupancies which are permitted
to utilize the Village-owned dumpsters located within the C-V Zoning
District of the Village. The boundaries of the Commercial Collection
District shall be determined by resolution of the Board of Trustees.
The boundaries of the Commercial Collection District may be changed
or modified from time to time by resolution of the Board of Trustees.
Streets, roads, avenues, sidewalks, thoroughfares, highways,
parks, parkways, alleys, squares, plazas and any and all places not
exclusively subject to private ownership, occupation or control.
Any device in, upon or by which any person or property is
or may be transported or drawn upon a public highway, regardless of
its means of propulsion, except a baby carriage and devices used exclusively
on stationary rails or tracks.
All refuse, garbage, ashes and rubbish shall be removed with
reasonable frequency so that the same shall not constitute or contribute
to the creation of a nuisance.
No person shall dump, bury, burn, deposit, throw, cast or lay,
or direct, suffer or permit any agent or employee to dump, bury, burn,
deposit, throw, cast or lay, any refuse, garbage, ashes, automobiles
or parts thereof, cinders, shells, dirt, filth, broken glassware,
crockery, bottles, cans or rubbish of any kind or nature whatsoever
in or upon any vacant or improved lot, lots or plots or in public
parks, playgrounds, parking fields, woodlands, lakes, ponds or other
waters within the boundaries of the Village.
No burning of garbage or outdoor burning of wood shall be permitted
within the Village.
No person shall place, scrape or throw any household or business
waste, trash, garbage or rubbish in any public litter basket.
Containers for garbage and refuse shall be constructed of metal
or plastic and shall be fitted with tight-fitting lids resistant to
rodents and vermin.
A.
Location of containers in nonresidential districts. All containers
for garbage, rubbish and other refuse in nonresidential districts
shall be kept within the premises or at the rear of the building where
practicable, until removed by the garbage collector. No such receptacle
and no refuse or rubbish shall be so placed or stored as to constitute
or contribute to the creation of a nuisance or hazard.
B.
Location of containers in residential districts. All containers for
garbage, rubbish and other refuse in residential districts shall be
kept at the rear of the building where practicable, until removed
by the garbage collector.
