The Facade Review District shall be all of the area within the Business A District of the Village and all other areas within 200 feet of Middle Neck Road within the Village.
A. 
No person may erect, alter, rebuild, enlarge, extend, or relocate a building in the Facade Review District without a facade permit from the Board of Trustees.
B. 
No person may change the facade of any building in the Facade Review District without a facade permit from the Board of Trustees.
C. 
Exceptions: This section shall not apply to:
(1) 
Legal single-family dwellings;
(2) 
The repainting or restaining of a facade with the same color paint or the same color stain;
(3) 
The restuccoing of a facade with the same color stucco; and
(4) 
Minor maintenance and repairs, not exceeding 5% of a facade, with the same materials and of the same colors, so long as such minor maintenance and repairs do not exceed 20% of the facade within any three year period.
D. 
The fee for a facade permit shall be set from time to time by resolution of the Board of Trustees.
A. 
The facade includes, but is not limited to, the height, width, and rooflines; the materials, colors, and textures of the surfaces; the size and arrangement of doors, windows, porticoes, and other openings; the breaks in the facade; and cornices, columns, and other design features.
B. 
The Board of Trustees shall consider the following criteria in reviewing facade permit applications:
(1) 
Excessive uniformity with other buildings in the Business A District;
(2) 
Excessive dissimilarity to other buildings in the Business A District;
(3) 
Poor quality of design;
(4) 
Poor quality of materials; and
(5) 
Whether the facade is in keeping with the long-term plan for the upgrading of the Facade Review District, as such plan develops and evolves.
C. 
The Board of Trustees shall have the power to approve with conditions, modify with conditions, or disapprove any such application.
The Board of Trustees, in reviewing the facade of any building pursuant to this article, may elect to perform all or a part of the review otherwise required by the Committee of Architectural Review pursuant to Article XVIII of this chapter with regard to such facade and building, and, if it so elects, it shall acknowledge such election and the extent of such election in its determination, and, to the extent of such election, it shall have all of the powers of the Committee of Architectural Review, and, by its election, no separate application need be made to the Committee of Architectural Review to the extent of such election.
