No person shall keep any animals in the Borough except in accordance
with the provisions of this article.
This article shall not apply to the keeping of dogs and cats which are licensed and regulated under the provisions of Chapter 74 of this Code.
A.Â
The premises on which animals are maintained and kept shall meet
and conform to the following health standards:
(1)Â
Location is such as to preclude odors and sounds from interfering
with the comfortable enjoyment of life and property on neighboring
premises.
(2)Â
Buildings, food storage bins, appliances, equipment, feeding areas
and other facilities on premises are constructed and maintained in
such a fashion as to permit proper cleaning.
(3)Â
Water supply is adequate for proper sanitation.
(4)Â
Water or other liquid to which mosquitoes may have access is properly
treated to prevent their breeding.
(5)Â
Disposition is made of animal wastes, garbage, refuse or vegetable
matter deposited upon the premises in such a manner as to prevent
insect breeding or rodent harborage or pollution of the air or any
body of water or the creation of any other unhealthy or unsanitary
condition.
(6)Â
Rodents or insects hazardous to public health do not exist or reproduce
therein or thereon.
(7)Â
Adequate measures are taken to prevent animals from escaping.
(8)Â
Adequate equipment is available to maintain the premises in a sanitary
condition at all times.
B.Â
The Health Officer of the Borough is authorized to inspect any premises
where animals under this section are kept for the purpose of enforcing
the provisions herein.
A.Â
RAISING AND KEEPING OF LIVESTOCK
Definitions. As used in this article, the following terms shall have
the meanings indicated:
The breeding or quartering of animals customarily found on
a farm, including but not limited to horses, cows, ponies, sheep,
goats, chickens, pigs, ducks or other fowl, or other farm animals.
This term shall not include the keeping of cats, dogs or other domestic
animals.
B.Â
The raising and keeping of livestock, as defined above, is prohibited
except as set forth below:
(1)Â
No more than one pot-bellied pig may be kept per household provided
that a permit is issued by the Borough Clerk. No permit shall be issued
until the prospective pet owner first satisfies the following conditions:
(a)Â
The prospective owner shall obtain the written approval of each
property owner within 200 feet of the owner's residence. A list of
all property owners within 200 feet of the owner's residence shall
be obtained from the Borough Clerk upon payment of the appropriate
fees. The written approvals shall be filed with the Borough Clerk
prior to any permit being issued. In the event any property owner
within 200 feet of the owner's residence does not provide her written
consent, then no permit shall issue unless the governing body consents
after a hearing at which time all interested parties may be heard.
The prospective owner is responsible for notifying all property owners
within 200 feet of the owner's residence of the time and place of
the hearing and shall file proof that such notice was provided in
accordance herewith with the Borough Clerk.
(b)Â
The prospective owner shall obtain verification from a veterinarian
licensed by the State of New Jersey that the pig has received all
required inoculations as required by state law and by any of the boards
of health having jurisdiction.
(c)Â
The prospective owner shall certify that the pig is neutered
or will be neutered within 60 days of its moving to Palmyra.
Any person or persons, business entity or other who violates
the provisions of this article shall be subject to a fine in the municipal
court not to exceed $500.
