A Board of Health shall be appointed and constituted within
the limits of the Borough pursuant to N.J.S.A. 26:3-1 et seq., and
it shall exercise its respective powers and duties as set forth herein
and as set forth in the applicable statutes.
A.
The Board
of Health of the Borough shall consist of seven members plus up to
two alternates, as provided for in N.J.S.A. 26:3-3, to be appointed
by the Mayor and Council of the Borough.
B.
The terms
of office for each of the seven regular members of the Board shall
be three years each and shall be staggered so that no more than three
of the seven seats on the Board shall have their terms expire in any
year. As to the two alternates, their terms of office shall be for
two years, except that, upon initial appointment, it shall be established
such that the terms of office for Alternate No. 1 and Alternate No.
2 shall not expire on the same year. The members of the Board of Health
shall hold office for the terms set forth above and until their successors
shall qualify. Nothing contained in this subsection shall affect the
term of office of any member of the Board of Health appointed prior
to the adoption hereof.
C.
Alternate
members may participate in discussions but may not vote except in
the absence or disqualification of a regular member. Alternate No.
1, if available, shall vote in connection with the first vacancy,
absence or disqualification and Alternate No. 2 shall vote in connection
with the second vacancy, absence or disqualification.
On or before January 15 of each year, the Board of Health shall
present to the Governing Body the appropriation estimate provided
for in N.J.S.A. 26:3-43 for its consideration in establishing its
budget and the appropriation for the Board of Health.
The Board of Health shall exercise all of the powers and prerogatives
and perform all of the duties set forth in N.J.S.A. 26:3-1 et seq.,
and as otherwise provided for local boards of health.
The Board shall organize by the election of one of its Board
as President and shall appoint a Secretary and such other subordinate
officers and agents to carry into effect the act as it may deem necessary
and shall fix the term of such appointments and the compensation of
such appointees.
