This article is hereby established to create the requirements
for the installation and maintenance of smoke detectors in one- and
two-family dwelling units upon the sale or rental of the same.
Upon the sale of a one- or two-family residence, or the rental,
lease or transfer of any dwelling unit, the seller, landlord or transferor
is required to obtain from the Borough of Westwood a smoke detector
compliance certificate complying with the provisions of this article.
The fee for the smoke detector compliance certificate shall be $25.
Applications shall be submitted to the Building Department with a
copy to the Fire Prevention Bureau of the Borough of Westwood, and
the application fee shall be prepaid. Within 10 business days of the
receipt of said application, the Borough official charged with the
duty of making inspections for continued certificates of occupancy
shall inspect the premises to determine whether the same complies
with the terms of this article. If application is made in conjunction
with the certificate of occupancy inspection, the fee shall be waived.
Any violation of the provisions of this article shall be punishable
by a maximum fine of $5,000 per violation per day that the violation
continues to exist.
