[Adopted 10-5-1978 by Ord. No. 2335 as §§ 22-34 to 22-38 of the 1978 Revised General Ordinances]
As used in this article, the following terms shall have the meanings indicated:
PLANT LIFE
Includes any hedge, brush or other plant life on lands within the City.
The owner or tenant of any lands shall keep all plant life, growing within 10 feet of any roadway and within 25 feet of the intersection of two roadways, cut to a height of not more than 2 1/2 feet.
If plant life on any land is permitted to grow to such height as to constitute noncompliance with the provisions of § 380-35, then either the Chief of Police, or a person designated by him, or the Chief Inspector, or a person designated by him, shall serve upon either or both the owner or tenant of such land, personally or by certified or registered mail, return receipt requested, a written notice directing such person, within 10 days from receipt of such notice, to trim such plant life so as to comply with the provisions of § 380-35, provided that the lien provisions of § 380-38 hereof shall be applicable only if such notice shall have been served personally on, or mailed in the above-described manner, to the owner of such land; and provided, further, that such mailing to the address maintained in the office of the Tax Collector as the address to which tax bills respecting such land are to be mailed shall constitute compliance with the provisions hereof.
Any person who fails to comply with such notice within such specified time shall be guilty of a violation of this article and, upon conviction thereof, shall be punished by a fine not exceeding $500 or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
If any person shall fail to comply with a notice served pursuant to § 380-36 within the time specified therein, then, at any time following expiration of such time period, the City official who caused such notice to be served may cause such plant life to be trimmed so as to comply with the provisions of § 380-35. The reasonable cost thereof, as approved by the Council, shall be charged to the owner of said land and shall become a lien thereon and shall be added to and become and form part of the taxes next to be assessed and levied upon such lands. Such amount shall be collected and enforced by the same officer and in the same manner as taxes.
